1              Name of Standard

                This Standard is the Radiocommunications (Electromagnetic Compatibility) Standard 2008.

2              Commencement

                This Standard commences on the day after it is registered.

3              Object of Standard

                The object of this Standard is to contain interference to:

                (a)    radiocommunications; and

               (b)    any uses or functions of devices.

4              Revocation

                The Radiocommunications (Electromagnetic Compatibility) Standard 2001 made on 2 November 2001 is revoked.

5              Application of Standard

         (1)   This Standard applies to a device manufactured in, or imported into, Australia for supply.

         (2)   However, the Standard does not apply to a device mentioned in Schedule 2 to the Radiocommunications (Electromagnetic Compatibility) Labelling Notice 2008.

6              Definitions

                In this Standard:

ACMA means the Australian Communications and Media Authority.

Act means the Radiocommunications Act 1992.

applicable standard has the meaning given by section 7.

device has the meaning given by subsection 9 (1) of the Act.

list of standards means the list of standards published from time to time on the following web address: http://www.acma.gov.au/standards/emc.

7              Definition of applicable standard

         (1)   In this Standard, applicable standard, in relation to a device and subject to subsections (2), and (3), has the meaning determined using the following table.

Note 1   Column 7 of the list of standards gives a manufacturer or importer of a device guidance about whether a particular standard listed in column 2 of Part 1 and 2 of the list of standards may apply to a device they manufacture or import.

Note 2   If an applicable standard mentioned in item 2 of the table in subsection 7 (1) has passed its expiry date, information in column 10 of the list of standards may give details about a replacement standard, including the name and commencement date of the replacement standard.

         (2)   A standard in column 2 of Part 1 and 2 of the list of standards is not an applicable standard if the expiry date mentioned in the standard has passed.

         (3)   For item 1 of the table, if more than one standard in column 2 of Part 2 of the list of standards is identified as an applicable standard for a device the manufacturer or importer of a device may choose 1 of those to be the applicable standard for the device.

8              Modifying information in a standard

                If the list of standards has both a standard in column 2 and modifications in column 10, the standard in column 2 of the list of standards is taken to be the version as modified by column 10.

9              Compliance

         (1)   A device must comply with an applicable standard.

         (2)   However, this Standard requires compliance with matters contained in a standard referred to in section 7 only to the extent to which those matters relate to interference to:

                (a)    radiocommunications; and

               (b)    any uses or functions of devices.
