This instrument is the Remuneration Tribunal (Members of Parliament) Amendment Determination (No. 1) 2026.

(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under sections 45, 46 and 46A of the Parliamentary Business Resources Act 2017.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Part 1—General amendments

Remuneration Tribunal (Members of Parliament) Determination 2024

1 After clause 2.4

Insert:

2.4A An amount is determined for paragraph 14(3)(b) of the PBR Act for the leader of the third largest party in the House of Representatives only if the leader of the third largest party in the House of Representatives does not receive salary as a Minister of State.

2.4B An amount is determined for paragraph 14(3)(b) of the PBR Act for the leader of a minority party only if the leader of a minority party is not entitled to receive additional salary as the leader of the third largest party in the House of Representatives.

2 After paragraph 5.4(a)

Insert:

aa. Leader of the third largest party in the House of Representatives;

3 Schedule A (after table item dealing with Leader of the Opposition in the Senate)

Insert:

Leader of the third largest party in the House of Representatives

Part 2—Transitional provisions

Remuneration Tribunal (Members of Parliament) Determination 2024

5 At the end of Part 7

Add:

The leader of the third largest party in the House of Representatives

7.2 The amendments made by Part 1 of Schedule 1 to the Remuneration Tribunal (Members of Parliament) Amendment Determination (No. 1) 2026 apply on and after 1 July 2024.

7.3 For the purposes of determining an office holder’s salary and rate of Australian travel allowance under a determination specified in clause 7.4 (an old determination), for a period beginning on or after 21 May 2022, the old determination is to be read as if:

a. the old determination included clauses 2.4A and 2.4B of this determination; and

b. the office of leader of the third largest party in the House of Representatives was referred to in clause 5.2 of the old determination; and

c. the table in Schedule A to the old determination included the office of leader of the third largest party in the House of Representatives, with an office holder’s salary of 45% of the base salary.

7.4 The following determinations are specified for the purposes of clause 7.3:

a. the Remuneration Tribunal (Members of Parliament) Determination 2021;

b. the Remuneration Tribunal (Members of Parliament) Determination 2022;

c. the Remuneration Tribunal (Members of Parliament) Determination (No. 1) 2023;

d. the Remuneration Tribunal (Members of Parliament) Determination (No. 2) 2023.
