The Australian Communications and Media Authority makes the following instrument under section 132 of the Radiocommunications Act 1992.

  This is the Radiocommunications (Cellular Mobile Telecommunications Devices) Class Licence Variation 2026 (No.1).

  This instrument commences at the start of the day after the day it is registered on the Federal Register of Legislation.

  This instrument is made under section 132 of the Radiocommunications Act 1992.

  The instrument that is specified in Schedule 1 is varied as set out in the applicable items in that Schedule.

1  Subsection 5(1)

Insert:

transmit power control means a function that changes the power at which a radiocommunications transmitter operates, to maintain a particular level of reception quality.

2  Subsection 5(1) (note 1)

Insert:

(ca) frequency band;

3  After section 11

Insert:

 (1) A person must not operate a radiocommunications device in the 1900 MHz to 1910 MHz frequency band if the device exceeds a total radiated power of 31 dBm/10MHz.

 (2) A person must not operate a radiocommunications device in the 1900 MHz to 1910 MHz frequency band unless the person uses transmit power control on the device.
