This instrument is the Public Governance, Performance and Accountability Amendment (Procurement Reporting Measures) Rules 2026.

(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Public Governance, Performance and Accountability Act 2013.

Schedule 1—Amendments

Part 1—Procurement reporting measures

Public Governance, Performance and Accountability Rule 2014

1 Section 4 (definition of Commonwealth Procurement Rules)

Repeal the definition (including the note), substitute:

Commonwealth Procurement Rules means the Commonwealth Procurement Rules 17 November 2025, as in force on 17 November 2025.

Note: The Commonwealth Procurement Rules 17 November 2025 were made by the Finance Minister under subsection 105B(1) of the Act.

2 Section 17AA (paragraph beginning “These requirements”)

Repeal the paragraph.

3 Paragraph 17AG(10)(c)

Omit “The results of the Survey of Australian Government Payments to Small Business are available on the Treasury’s website”, substitute “Further information on payment times can be found at [entity web address]”.

4 Subsection 17AG(10) (note)

Repeal the note, substitute:

Note: See the Commonwealth Procurement Rules for requirements for procurement practices of Commonwealth entities to support small and medium enterprises.

5 Section 17BA (paragraph beginning “These requirements”)

Repeal the paragraph.

6 At the end of Subdivision B of Division 3A of Part 2‑3

Add:

17BG Additional requirement for prescribed corporate Commonwealth entities

(1) This section applies in relation to a corporate Commonwealth entity that is prescribed under section 30.

(2) The annual report for a reporting period for the corporate Commonwealth entity must include an assessment of the entity’s performance during the period against the Commonwealth Procurement Rules.
