Higher Education (Disclosure of Information to Other Bodies) Determination 2023

1  Name

  This instrument is the Higher Education Support Legislation Amendment (Disclosure of Information to Certain Agencies) Instrument 2026.

2  Commencement

  This instrument commences the day after registration.

3  Authority

  This instrument is made under subsection 180-25(4) and section 238-10 of the Higher Education Support Act 2003.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Higher Education Support (Administration) Guidelines 2022

1  After section 30

Insert:

Part 9 – Disclosure of information to certain agencies

31  Agencies to which information can be disclosed  

 For the purposes of paragraph 180-23(2)(d) of the Act, an agency is also covered by subsection 180-23(2) of the Act if it is administered by the Minister who administers any of the following Acts:

 (a) the Australian Institute of Health and Welfare Act 1987;

 (b) the Census and Statistics Act 1905;

 (c) the Jobs and Skills Australia Act 2022; and

 (d) the Ombudsman Act 1976.
