Carbon Credits (Carbon Farming Initiative) Rule 2015

 

 

  This instrument is the Carbon Credits (Carbon Farming Initiative) Amendment (Savanna Fire Management Projects) Rules 2026.

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this instrument

At the same time as the Carbon Credits (Carbon Farming Initiative—Savanna Fire Management—Sequestration and Emissions Avoidance) Methodology Determination 2026 commences.

 

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

  This instrument is made under sections 166A and 308 and subsection 29(1) of the Carbon Credits (Carbon Farming Initiative) Act 2011.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

1  Sub-subparagraph 23(1)(cb)(i)(B)

After "former areabased emissions avoidance project”, insert “unless the area-based emissions avoidance project that the area of land is being moved to is covered by the Carbon Credits (Carbon Farming Initiative—Savanna Fire Management—Emissions Avoidance) Methodology Determination 2026”.

2  After section 23

Insert:

  1.     Despite section 23, any variation of the section 27 declaration of a savanna emissions avoidance project or a savanna sequestration project, so far as the declaration identifies the project area or areas after the start of the crediting period, must be for one or more of the following only:
  1.     to add an additional project area;
  2.     to remove an entire project area and replace it with subdivided project areas;
  3.    to remove an entire subdivided project area and not replace it;
  4.    to remove an entire project area from a project with more than one project area (but only if all abatement calculations for that project area have been carried out separately from the other project areas throughout the crediting period).
  1.     Subsection (1) does not apply in relation to a project under the Carbon Credits (Carbon Farming Initiative) (Reduction of Greenhouse Gas Emissions through Early Dry Season Savanna Burning—1.1) Methodology Determination 2013 or the Carbon Credits (Carbon Farming Initiative—Emissions Abatement through Savanna Fire Management) Methodology Determination 2015.
  2.     In this section, a subdivided project area for a project has the same meaning as in the applicable methodology determination for the project.

3  Section 53

Before “The”, insert “(1)”.

4  At the end of section 53

Add:

  1.     However, this section does not apply to a transferee offsets project that is covered by any of the following methodology determinations:
  1.     Carbon Credits (Carbon Farming Initiative—Savanna Fire Management—Sequestration and Emissions Avoidance) Methodology Determination 2026;
  2.     Carbon Credits (Carbon Farming Initiative—Savanna Fire Management—Emissions Avoidance) Methodology Determination 2026.

5  At the end of subsection 93A(1)

Add:

; (i) if the project is a savanna emissions avoidance project or a savanna sequestration project, the vegetation fuel type maps submitted by the project proponent;

(j) if the project is a savanna emissions avoidance project or a savanna sequestration project and the Regulator has made a decision to approve an application made under subsection (2) for non-publication of information specified in paragraph (i), a map which identifies any parts of the project areas that are classified as ineligible in accordance with the vegetation fuel type map.

6  At the end of subparagraph 93A(2)(b)(ii)

Add:

; or

 (iii) in relation to information specified in paragraph (1)(i), the information is subject to a contractual obligation between the project proponent and a person contracted to create or validate that information which prevents its publication.

7  At the end of Part 29

Add:

Division 5— Application provisions relating to the Carbon Credits (Carbon Farming Initiative) Amendment (Savanna Fire Management Projects) Rules 2026

129  Amendments made by the Carbon Credits (Carbon Farming Initiative) Amendment (Savanna Fire Management Projects) Rules 2026

  1.     During the transitional period, the Regulator is not required to comply with paragraphs 93A(1)(i) or (j) in respect of any information:
    1.     held by the Regulator at the commencement of the transitional period; or
    2.     acquired by the Regulator during the transitional period.
  2.     In this section:
    transitional period means the period of 6 months beginning at the commencement of the Carbon Credits (Carbon Farming Initiative) Amendment (Savanna Fire Management Projects) Rules 2026.
