Renewable Energy (Electricity) Regulations 2001
This instrument is the Renewable Energy Legislation Amendment (2026 Measures No. 1) Regulations 2026.
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the following:
(a) the Clean Energy Regulator Act 2011;
(b) the Renewable Energy (Electricity) Act 2000.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Repeal the subregulation, substitute:
(7) The amount is calculated by using the following method statement:
Method statement
Step 1. For the useable capacity (the tier 1 useable capacity) of the battery for the unit up to and including 14kWh, multiply the tier 1 useable capacity of the battery by the factor set out in the table in subregulation (8) that applies in relation to the battery.
Step 2. If the battery for the unit has a useable capacity greater than 14kWh, for the useable capacity (the tier 2 useable capacity) of the battery greater than 14kWh but less than or equal to 28kWh, multiply the tier 2 useable capacity of the battery by the following:
(a) the factor set out in the table in subregulation (8) that applies in relation to the battery;
(b) 0.6.
Step 3. If the battery for the unit has a useable capacity greater than 28kWh, for the useable capacity (the tier 3 useable capacity) of the battery greater than 28kWh but less than or equal to 50kWh, multiply the tier 3 useable capacity of the battery by the following:
(a) the factor set out in the table in subregulation (8) that applies in relation to the battery;
(b) 0.15.
Step 4. The amount is:
(a) if an amount was worked out under step 2 or 3—the sum of the amounts worked out under steps 1 to 3 rounded down to the nearest whole number; or
(b) in any other case—the amount worked out under step 1 rounded down to the nearest whole number.
(8) For the purposes of the method statement in subregulation (7), the factor to apply in relation to a battery for a unit is worked out using the following table.

Insert:
The amendments of these Regulations made by Schedule 1 to the Renewable Energy Legislation Amendment (2026 Measures No. 1) Regulations 2026 apply to the creation of certificates in relation to a battery connected (solar PV) small generation unit where the battery for the unit is certified for compliance (as mentioned in paragraph 19D(4)(b)) on or after 1 May 2026.

small‑scale technology certificate has the same meaning as in the Renewable Energy (Electricity) Act 2000.

For the purposes of paragraph 12(ba) of the Act, a function of the Regulator is purchasing and surrendering, or supporting the Department to purchase and surrender, small‑scale technology certificates for the purposes of the program established by the Commonwealth and known as the Cheaper Home Batteries Program.
