This instrument is the Greenhouse and Energy Minimum Standards (GEMS Regulator) Delegation 2025.
This instrument commences on 20 September 2022.
Note: Subsection 12(1A) of the Legislation Act 2003 provides that a legislative instrument or notifiable instrument may provide that the instrument, or a provision of the instrument, commences before the instrument is registered. Upon registration of this instrument as a notifiable instrument, this instrument would be a notifiable instrument (see paragraph 11(2)(c) of the Legislation Act 2003).
This instrument is made under section 80 of the Greenhouse and Energy Minimum Standards Act 2012.
In this instrument:
Act means the Greenhouse and Energy Minimum Standards Act 2012.
Delegation period – see section 6.
Under section 80 of the Act, and with the agreement of the State of Victoria, the functions and powers listed in each item of the table in Schedule 1 are delegated to the employees of Energy Safe Victoria who occupied or performed the duties of the positions specified therein during the delegation period.
The delegations referred to in section 5 of this instrument apply for the period 20 September 2022 to 17 September 2024 (the delegation period).
This instrument is to be taken as a subsequent delegation for the purposes of interpreting the application of any revocation clause contained in any previous delegation instrument made under section 80 of the Act.
