This instrument is made under section 114(1) of the Carbon Credits (Carbon Farming Initiative) Act 2011.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
1 Section 17
Repeal the section, substitute:
17 Crediting period for non-biomethane projects
For paragraph 69(3)(b) and subparagraph 70(3)(d)(ii) of the Act, if an animal effluent management project is a non-biomethane project that, during its crediting period or periods:
(a) uses biogas to generate electricity—the period of 15 years is specified; or
(b) uses a flare as a combustion device—the period of 15 years is specified; or
(c) is any other project to which paragraphs (a) or (b) do not apply—the period of 12 years is specified.
2 Paragraph 34(d)
Omit “non-biomethane project or a”.
3 Paragraph 34(d) (note)
Omit “subsections 17(3) and 17A(3)”, substitute “subsection 17A(3)”.
