Schedule 1—Amendments

Australian Citizenship Regulation 2016

1  Name

  This instrument is the Australian Citizenship Amendment (Notices of Citizenship) Regulations 2025.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under the Australian Citizenship Act 2007.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Australian Citizenship Regulation 2016

1  Section 5

Insert:

presiding officer means any of the following persons before whom a pledge of commitment may be made:

 (a) a person authorised under subsection 27(4) of the Act;

 (b) a person included in a class of persons authorised under subsection 27(5) of the Act.

2  Subsection 12(3)

Repeal the subsection, substitute:

 (3) The signature of one or more presiding officers may be included on the notice.

 (3A) The signature of a presiding officer, if included on the notice, may be a facsimile that is printed or stamped.

 (3B) A presiding officer whose signature appears on the notice need not be the presiding officer before whom the pledge of commitment was made by the person who is the subject of the notice.

3  In the appropriate position in Part 4

Insert:

37  Application of amendments made by Schedule 1 to the Australian Citizenship Amendment (Notices of Citizenship) Regulations 2025

  The amendments of this instrument made by Schedule 1 to the Australian Citizenship Amendment (Notices of Citizenship) Regulations 2025 apply in relation to a notice given under subsection 37(2) of the Act, whether the application for the notice was made before, on or after the commencement of Schedule 1 to those regulations.

4  Schedule 2 (Form)

Repeal the form, substitute:

 Australian Citizenship

 (full name of citizen)

 born on (date of citizen’s birth)

I, the Minister administering the Australian Citizenship Act 2007, give notice that the abovenamed is an Australian citizen and that citizenship was acquired on (date of acquisition or birth).
