Schedule 1—Amendments

Financial Framework (Supplementary Powers) Regulations 1997

 

  This instrument is the Financial Framework (Supplementary Powers) Amendment (Social Services Measures No. 2) Regulations 2025.

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Insert:

Grant to the Rev Bill Crews Foundation Ltd

To provide funding to the Rev Bill Crews Foundation Ltd to support Australians experiencing financial hardship by:

(a) providing specialist support for people experiencing family, domestic or sexual violence; and

(b) providing play therapy services for children; and

(c) providing literacy programs for children and young people; and

(d) supporting the provision of medical, dental and other health services.

This purpose has the effect it would have if it were limited to measures:

(a) for the provision of, or incidental to the provision of, medical and dental services (within the meaning of paragraph 51(xxiiiA) of the Constitution); or

(b) to give effect to Australia’s obligations under one or more of the following:

(i) the Convention on the Elimination of All Forms of Discrimination Against Women, particularly Articles 1, 2, 3, 5 and 16;

(ii) the Convention on the Rights of the Child, particularly Articles 4, 19, 23, 24, 27, 28 and 29;

(iii) the International Covenant on Civil and Political Rights, particularly Articles 2, 7, 9 and 17;

(iv) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12;

(v) the Single Convention on Narcotic Drugs, 1961, as amended by the 1972 Protocol, particularly Articles 4 and 38; or

(c) undertaken in, or in relation to, a Territory.

Grant to Partnerships for Local Action and Community Empowerment Ltd

To provide funding to Partnerships for Local Action and Community Empowerment Ltd to enable placebased change through supporting the development and implementation of placebased approaches, partnerships and solutions (placebased initiatives) that improve social and economic outcomes in communities, and advance public welfare, including by:

(a) developing, disseminating and promoting the exchange of resources, tools and frameworks, and promoting best practice models, relating to placebased initiatives; and

(b) promoting and enabling strengthened data practices in placebased initiatives, including generating an evidence base that validates the impact of placebased initiatives; and

(c) building the skills and capabilities of the workforce to better develop and deliver placebased initiatives; and

(d) supporting stakeholders to identify and seek collaborative resolutions to local challenges and to systemic challenges that have a significant or national impact; and

(e) promoting the development of policy and funding approaches that support effective placebased initiatives; and

(f) supporting the adoption of placebased initiatives, including the development and practice of shared decisionmaking; and

(g) providing the operational infrastructure and other associated costs required to deliver on this purpose.

This purpose has the effect it would have if it were limited to measures, or measures for the delivery of Commonwealth programs:

(a) in connection with trade and commerce with other countries, or among the States and Territories; or

(b) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or

(c) with respect to census and statistics; or

(d) with respect to aliens (within the meaning of paragraph 51(xix) of the Constitution); or

(e) for the provision of, or incidental to the provision of, unemployment, pharmaceutical, sickness and hospital benefits, medical and dental services or benefits to students (within the meaning of paragraph 51(xxiiiA) of the Constitution); or

(f) with respect to Indigenous Australians and particular groups of Indigenous Australians; or

(g) with respect to immigrants; or

(h) to give effect to Australia’s obligations under one or more treaties, including the following:

(i) the Convention on the Elimination of All Forms of Discrimination Against Women, particularly Articles 2, 3, 5, 6, 12 and 16;

(ii) the Convention on the Rights of Persons with Disabilities, particularly Articles 4 and 27;

(iii) the Convention on the Rights of the Child, particularly Articles 4, 6, 18, 19, 24, 27, 28, 29, and 30;

(iv) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2, 6, 10 and 12; or

(i) involving the granting of financial assistance to a State or Territory; or

(j) undertaken in, or in relation to, a Territory; or

(k) that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or

(l) undertaken in the exercise of the executive power of the Commonwealth.

This purpose also has the effect that it would have if it were limited to measures that are undertaken for the purpose of, or in connection with, any program specified in an item in Part 4 of this Schedule that is supported by any other Commonwealth legislative power.
