Schedule 1—Amendments

 

  This instrument is the Financial Framework (Supplementary Powers) Amendment (Agriculture, Fisheries and Forestry Measures No. 1) Regulations 2025.

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Rural Financial Counselling Service Program

To provide financial counselling services to eligible farmers, fishers, foresters and small related businesses experiencing, or at risk of, financial hardship.

This objective has the effect it would have if it were limited to measures:

(a) in connection with trade and commerce with other countries, or among the States and Territories; or

(b) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or

(c) with respect to bankruptcy or insolvency (within the meaning of paragraph 51(xvii) of the Constitution); or

(d) to give effect to Australia’s obligations under one or more of the following:

(i) the Kyoto Protocol to the United Nations Framework Convention on Climate Change, particularly Article 10;

(ii) the Paris Agreement, particularly Article 7;

(iii) the United Nations Convention to Combat Desertification in those Countries Experiencing Serious Drought and/or Desertification, particularly in Africa, particularly Articles 4 and 5;

(iv) the United Nations Framework Convention on Climate Change, particularly Article 4; or

(e) that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or

(f) undertaken in the exercise of the executive power of the Commonwealth.
