  This instrument is the Veterans’ Entitlements (Treatment and Other Matters) Amendment (Aged Care Act 2024) Instrument 2025.

  This instrument commences at the same time that the Aged Care Act 2024 commences.

  This instrument is made under the following provisions:

  1.      section 88A of the Veterans’ Entitlements Act 1986;
  2.      paragraph 5H(12)(c) of the Veterans’ Entitlements Act 1986;
  3.      subsection 52ZZZWB(4) of the Veterans’ Entitlements Act 1986.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

 

1  Section 5, definition of residential care, Note (2)

repeal the note, substitute

Note (2): The Repatriation Commission or the Military Rehabilitation and Compensation Commission may accept financial responsibility for a resident contribution under subsection 276(1) of the Aged Care Act 2024 in accordance with the Treatment Principles or the MRCA Treatment Principles.

2  Section 5, definition of residential care (respite), Note (2)

repeal the note, substitute

Note (2): The Repatriation Commission or the Military Rehabilitation and Compensation Commission may accept financial responsibility for a resident respite fee under subsection 283(2) of the Aged Care Act 2024 in accordance with the Treatment Principles or the MRCA Treatment Principles.

of an aged care service within the meaning of the Aged Care Act 1997 (as in force immediately before the commencement of the Aged Care Act 2024)

repeal the subparagraph, substitute

  1.    a registered provider (within the meaning of subsection 11(2) of the Aged Care Act 2024) who is providing to the principal beneficiary a service in the service group specified in paragraph 8(3)(b) of that Act; or
