This instrument is the Health Insurance (Section 3C Midwife and Nurse Practitioner Services) Amendment (Nurse Practitioner Surgical Assistance) Determination 2025.

Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under subsection 3C(1) of the Health Insurance Act 1973.

Schedule 1—Amendments

Health Insurance (Section 3C Midwife and Nurse Practitioner Services) Determination 2020

1 Subsection 5(1)

Insert:

amount under clause 3.1 has the meaning given by clause 3.1 of Part 3 of Schedule 2.

amount under clause 3.2 has the meaning given by clause 3.2 of Part 3 of Schedule 2.

amount under clause 3.3 has the meaning given by clause 3.3 of Part 3 of Schedule 2.

Part 3 Nurse practitioner surgical assistance services and fees

3.1 Meaning of amount under clause 3.1

In item 93719:

amount under clause 3.1, for assistance at an operation or series or combination of operations, means 20% of the sum of the fees payable under the Act for the services provided at that operation, or series of operations, by the practitioner to whom the assistance was given.

3.2 Meaning of amount under clause 3.2

In item 93721:

amount under clause 3.2, for assistance at a series or combination of operations, means:

(a) 20% of the sum of the fees payable under the Act for the services provided at those operations by the practitioner to whom the assistance was given; or

(b) for the caesarean section component of the operations—the fee mentioned in item 16520.

3.3 Meaning of amount under clause 3.3

In item 93722:

amount under clause 3.3, for assistance at a procedure, means 20% of the sum of the fees payable under the Act for the services provided at that procedure or combination of procedures by the practitioner to whom the assistance was given.
