Migration (International trade obligations relating to labour market testing) Amendment (CEPA) Determination 2025

I, Julian Hill, Assistant Minister for Citizenship, Customs and Multicultural Affairs, make the following instrument.

  This instrument is the Migration (International trade obligations relating to labour market testing) Amendment (CEPA) Determination 2025.

 (1) This instrument commences on the later of:

 (a) the day after this instrument is registered; and

 (b) immediately after Schedule 1 to the Customs Amendment (Australia-United Arab Emirates Comprehensive Economic Partnership Agreement Implementation) Act 2025 commences.

 (2) However, this instrument does not commence at all if the event mentioned in paragraph (1)(b) does not occur.

  This instrument is made under subsection 140GBA(2) of the Migration Act 1958.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

1  Section 3

Repeal the section, substitute:

  This instrument is made under subsection 140GBA(2) of the Migration Act 1958.

Note: A number of expressions used in this instrument are defined in the Migration Act 1958, including labour market testing.

  In this instrument:

ASEAN means the Association of Southeast Asian Nations.

2  Section 5

Renumber as section 4.

3  After paragraph 5(d)

Insert:

 (da) Comprehensive Economic Partnership Agreement between Australia and the United Arab Emirates (CEPA);
