I, the Hon Michelle Rowland MP, Attorney-General, make this instrument under subsection 6R(2) of the Telecommunications (Interception and Access) Act 1979 and subsection 33(3) of the Acts Interpretation Act 1901.

6 Specification of persons

  This instrument is the Telecommunications (Interception and Access) (Communications Access Coordinator) Instrument 2025

  This instrument commences on the day after it is registered on the Federal Register of Legislation.

  This instrument is made under subsection 6R(2) of the Telecommunications (Interception and Access) Act 1979 and subsection 33(3) of the Acts Interpretation Act 1901.

  The Telecommunications (Interception and Access) (Communications Access Coordinator) Instrument 2024 dated 19 December 2024 is revoked.

  In this instrument:

Act means the Telecommunications (Interception and Access) Act 1979.

Classification Rules means the Public Service Classification Rules 2000.

APS level classification means any of the following classifications mentioned in column 2 of Schedule 1 of the Classification Rules:

  1.      APS Level 1;
  2.      APS Level 2
  3.       APS Level 3;
  4.      APS Level 4:
  5.       APS Level 5:
  6.        APS Level 6.

EL1 means an Executive Level 1 classification under the Classification Rules.

EL2 means an Executive Level 2 classification under the Classification Rules.

ICP Determination means the Interception Capability Plan Determination 2024.

Identity Checks Determination means Telecommunications (Service Provider — Identity Checks for Prepaid Mobile Carriage Services) Determination 2017.

Office of the Communications Access Coordinator Section means the work unit in the Attorney-General’s Department known as the Office of the Communications Access Coordinator, and which comprises APS1-6 and EL1 and EL2 staff performing duties or otherwise acting in positions in the section.

SES1 means a Senior Executive Band 1 classification under the Classification Rules.

SES2 means a Senior Executive Band 2 classification under the Classification Rules.

Telecommunications Act means the Telecommunications Act 1997.

 

  1.       For the purposes of paragraph (b) of the definition of Communications Access Coordinator in subsection 6R(1) of the Act, and for the powers and functions in sections 183, 187B and 187F, subsection 187G(6), section 187J, subsection 187K(1), paragraph 187K(5)(b), subsections 187K(6), 187K(7), 187K(8) and 188(4), section 202B and subsection 203(1) of the Act, persons from time to time holding or performing the duties of the following positions in the AttorneyGeneral’s Department are specified:
  1.    SES1 with responsibility for the Office of the Communications Access Coordinator Section;
  2.    SES2 with responsibility for the Office of the Communications Access Coordinator Section.

 

  1.       For the purposes of paragraph (b) of the definition of Communications Access Coordinator in subsection 6R(1) of the Act, and for the powers and functions in subsections 187G(2), 187G(4) and sections 192, 196, 197 and 198 of the Act, persons from time to time holding or performing the duties of the following positions in the AttorneyGeneral’s Department are specified:
  1.    in the Office of the Communications Access Coordinator Section
    1.        EL1;
    2.      EL2;
  2.    SES1 and SES2 with responsibility for the Office of the Communications Access Coordinator Section.

 

  1.       For the purposes of paragraph (b) of the definition of Communications Access Coordinator in subsection 6R(1) of the Act, and for the powers in subsection 187G(1), paragraph 187K(5)(a), section 187L, subsection 188(2), paragraph 188(9)(c), sections 202 and 202C and subsection 203(3) of the Act, persons from time to time holding or performing the duties of the following positions in the Attorney-General’s Department are specified:
  1.    in the Office of the Communications Access Coordinator Section
    1.        APS1-6;
    2.      EL1;
    3.    EL2;
  1.    SES1 and SES2 with responsibility for the Office of the Communications Access Coordinator Section.

 

  1.       For the purposes of paragraph (b) of the definition of Communications Access Coordinator in subsection 6R(1) of the Act, and for the powers and functions in section 56A of the Telecommunications Act, persons from time to time holding or performing the duties of the following positions in the AttorneyGeneral’s Department are specified:
  1.    SES1 and SES2 with responsibility for the Office of the Communications Access Coordinator Section.

 

  1.       For the purposes of paragraph (b) of the definition of Communications Access Coordinator in subsection 6R(1) of the Act, and for the powers and functions in sections 53A and 317ZF of the Telecommunications Act, persons from time to time holding or performing the duties of the following positions in the AttorneyGeneral’s Department are specified:
  1.    in the Office of the Communications Access Coordinator Section
    1.        APS1-6;
    2.      EL1;
    3.    EL2;
  2.    SES1 and SES2 with responsibility for the Office of the Communications Access Coordinator Section.

 

  1.       For the purposes of paragraph (b) of the definition of Communications Access Coordinator in subsection 6R(1) of the Act, and for the powers and functions in the ICP Determination and the Identity Checks Determination, persons from time to time holding or performing the duties of the following positions in the AttorneyGeneral’s Department are specified:
  1.    SES1 and SES2 with responsibility for the Office of the Communications Access Coordinator Section.
