  This instrument is the List of Exempt Native Specimens Amendment (South Australian Miscellaneous Dive Fishing Activities (Scallop, Sea Urchin, Specimen Shells and Turban Shell)) Instrument, July 2025

  This instrument commences on 25 July 2025.

  This instrument is made under subsection 303DC(1)(a) of the EPBC Act.

  In this instrument:

  EPBC Act means the Environment Protection and Biodiversity Conservation Act 1999.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

  1.         Under the heading Freshwater and Marine Animals

Specimens that are or are derived from invertebrates taken under licences and permits issued by the South Australian Department of Primary Industries and Regions in accordance with the management regime in force under the Fisheries Management Act 2007 (SA), Fisheries Management (Miscellaneous Developmental Fishery) Regulations 2013 (SA), Fisheries Management (Miscellaneous Fishery) Regulations 2015 (SA), and Fisheries Management (General) Regulations 2017 (SA) but not including:

  1.     specimens that belong to taxa listed under section 209 of the EPBC Act (Australia’s List of Migratory Species), or
  2.    specimens that belong to taxa listed under section 248 of the EPBC Act (Australia’s List of Marine Species), or
  3.     specimens that belong to eligible listed threatened species, as defined under section 303BC of the EPBC Act, or
  4.     specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES List).

Miscellaneous Dive Fishing Activities (Scallop, Sea Urchin, Specimen Shells and Turban Shell)

The specimen, or invertebrate from which it is derived, was taken lawfully.

Export approval for the South Australian Miscellaneous Dive Fishing Activities (Scallop, Sea Urchin, Specimen Shells and Turban Shell) (the fisheries) has been provided on the basis the fisheries will be managed in accordance with the Fisheries Management Act 2007 (SA), Fisheries Management (Miscellaneous Developmental Fishery) Regulations 2013 (SA), Fisheries Management (Miscellaneous Fishery) Regulations 2015 (SA), Fisheries Management (General) Regulations 2017 (SA), and the ‘Policy for the Management of the South Australian Commercial Miscellaneous Dive Fishing Activities’ (PIRSA 2017).

During the term of the export approval, the South Australian Department of Primary Industries and Regions must:

  1.     Consistent with Appendix B of the Guidelines for the Ecologically Sustainable Management of Fisheries, provide the Department of Climate Change, Energy, the Environment and Water (the department), with an annual report by 25 July each year.
  2.    In the interim, if there are any intended changes to legislative instruments, or material changes to management arrangements, that may affect the basis on which the export accreditation was made for this fishery, the department must be notified.

The specimens are included in the list until 25 July 2035.
