Communications (Radionavigation-Satellite Service Retransmission) Amendment Instrument 2025 (No. 1)

 

The Australian Communications and Media Authority makes the following instrument under subsection 60(1) and subsection 64(1) of the Australian Communications and Media Authority Act 2005.

  This is the Communications (Radionavigation-Satellite Service Retransmission) Amendment Instrument 2025 (No. 1).

  The instrument commences at the start of the day after the day it is registered on the Federal Register of Legislation.

  This instrument is made under subsection 60(1) and subsection 64(1) of the Australian Communications and Media Authority Act 2005.

  Each instrument that is specified in the Schedule to this instrument is amended as set out in the applicable items of the Schedule, and any other item in the Schedule to this instrument has effect according to its terms.

Insert:

2  Schedule 1 (Table 1, table item 2.1.11, column 2, paragraph (b))

Repeal the paragraph, substitute:

 (b) fixed licence (television outside broadcast system);

 (c) radiodetermination licence (RNSS repeater system)

3  Schedule

Insert:

indoors means a space that is:

 (a) enclosed by permanent walls on all sides, a permanent roof and a permanent floor; and

 (b) is permanently fixed to a location.

radiodetermination licence (RNSS repeater system) means a radiodetermination licence that authorises the operation of one or more radiocommunications transmitters, each of which is, or is part of, an RNSS repeater station in an RNSS repeater system.

radionavigation-satellite service has the meaning given by the spectrum plan.

RNSS frequency (short for radionavigation-satellite service frequency) means a frequency in a frequency band that the spectrum plan specifies is for use for the general purpose of the radionavigation-satellite service (whether or not the spectrum plan specifies the band is also for use for other purposes).

RNSS radiocommunication (short for radionavigation-satellite service radiocommunication) means a radiocommunication that is transmitted on an RNSS frequency.

RNSS receiver (short for radionavigation-satellite service receiver) means a radiocommunications receiver used to receive RNSS radiocommunications.

RNSS repeater station means a station that:

 (a) is used for the reception and automatic retransmission of RNSS radiocommunications; and

 (b) for the automatic retransmission of RNSS radiocommunications, is authorised by a radiodetermination licence; and

 (c) is located:

 (i) indoors; or

 (ii) in an underground environment; or

 (iii) in a tunnel; and

 (d) is operated in the following frequency bands only:

 (i) 1164 MHz to 1300 MHz;

 (ii) 1559 MHz to 1610 MHz; and

 (e) for which the ACMA, or a person accredited under section 263 of the Act, undertakes coordination procedures for the purpose of minimising interference.

RNSS repeater system means a system comprising one or more RNSS repeater stations, each of which is operated for the reception and automatic retransmission of RNSS radiocommunications between RNSS repeater stations or to an RNSS receiver.
