1  Name

  This instrument is the Superannuation Legislation Amendment (Family Law) Orders 2025.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under the following:

 (a) section 22CK of the Parliamentary Contributory Superannuation Act 1948;

 (b) section 93DE of the Superannuation Act 1922;

 (c) section 146MH of the Superannuation Act 1976.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Superannuation (Family Law — Parliamentary Contributory Superannuation Act 1948) Orders 2004

1  Subsection 1.03(1) (definition of FLS Regulations)

Repeal the definition.

2  Subsection 1.03(1) (definition of Secretary)

Omit “Department of Finance and Administration”, substitute “Finance Department”.

3  Clause 2 of Part 1 of Schedule 1 (table item 2, column headed “Method or factor”)

Omit:

substitute:

(ABP × Parl. A + AARA – PC) × DPFy+m

4  Subsection 3(1) (definition of FLS Regulations)

Omit “Family Law (Superannuation) Regulations 2001”, substitute “Family Law (Superannuation) Regulations 2025”.

Omit “subclause 2 (2) of Schedule 4”, substitute “clause 3 of Schedule 5”.

6  Section 6 (steps 3A and 3B)

Omit “subclause 2 (2) of Schedule 4”, substitute “clause 3 of Schedule 5”.
