Workplace Gender Equality (Matters in relation to Gender Equality Indicators) Instrument 2023

 

  This instrument is the Workplace Gender Equality (Matters in relation to Gender Equality Indicators) Amendment Instrument 2025.

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under subsection 13(3) of the Workplace Gender Equality Act 2012.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

 

1  Section 5 (before paragraph (a) of the note to the heading)

Insert:

(aa) Agency;

Insert:

family and domestic violence has the same meaning as in the Fair Work Act 2009.

3  Section 5 (definition of nonmanager)

Repeal the definition, substitute:

nonmanager, in relation to an employer, means an employee of the employer who is not a manager. For example, the following kinds of employees may be nonmanagers:

 (a) professionals;

 (b) technicians and trade employees;

 (c) community and personal service employees;

 (d) clerical and administrative employees;

 (e) sales employees;

 (f) machinery operators and drivers;

 (g) labourers;

 (h) graduates;

 (i) apprentices;

 (j) other nonmanagers.

4  Paragraph 8(1)(a)

Repeal the paragraph, substitute:

 (a) in relation to each employee, other than key management personnel with a reporting distance above the Chief Executive Officer or equivalent, the following information:

 (i) gender;

 (ii) employment status;

 (iii) year of birth;

 (iv) primary workplace location;

 (v) whether the employee is a manager or a nonmanager;

 (vi) information that is sufficient to allow the Agency to determine the employee’s annualised fulltime equivalent remuneration;

5  Paragraphs 9(n) and (o)

Omit “family or”, substitute “family and”.

6  In the appropriate position in Part 3

Insert:

  The amendments made by the Workplace Gender Equality (Matters in relation to Gender Equality Indicators) Amendment Instrument 2025 apply in relation to a reporting period that commences on a day after the day that instrument commences.
