1  Name

  This instrument is the Financial Framework (Supplementary Powers) Amendment (Infrastructure, Transport, Regional Development, Communications and the Arts Measures No. 4) Regulations 2024.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Strategic Fleet Pilot Program

To provide funding to enable the Australian Government to secure maritime capability to call on in times of need, such as natural disasters, crisis or conflict, including by:

(a) contributing towards meeting costs relating to vessel operation, flagging and seafarer training; and

(b) requisitioning vessels.

This objective has the effect it would have if it were limited to measures:

(a) in connection with trade and commerce with other countries, or among the States and Territories; or

(b) for the purposes of the defence of the Commonwealth and of the States; or

(c) with respect to places, persons, matters or things external to Australia or matters affecting Australia’s relations with foreign countries; or

(d) that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or

(e) undertaken in, or in relation to, a Territory.

Measures to Progress First Nations Digital Inclusion

To develop the digital ability and online safety of First Nations Australians in the use of a service (within the meaning of paragraph 51(v) of the Constitution) by providing funding:

(a) to establish services via the internet and telephone to:

(i) provide general digital support; and

(ii) support digital ability and connectivity literacy; and

(b) to develop culturally and linguistically appropriate resources and learning materials for the benefit of First Nations Australians; and

(c) to establish and maintain a network of digital mentors to:

(i) support First Nations Australians with internet connectivity and the use of devices for communication; and

(ii) support First Nations Australians to understand and use online services; and

(iii) increase awareness amongst First Nations Australians of online risks and mitigation measures.

Supporting Regional Aviation Programs

To provide funding for works (including repairs and upgrades) or services to improve safety, access and infrastructure at airports and aerodromes in regional and remote areas of Australia.

This objective has the effect it would have if it were limited to measures:

(a) in connection with trade and commerce with other countries, or among the States and Territories; or

(b) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or

(c) for the provision of medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution); or

(d) with respect to Indigenous Australians and particular groups of Indigenous Australians; or

(e) in relation to matters referred to the Parliament of the Commonwealth by the Parliament or Parliaments of any State or States; or

(f) involving the granting of financial assistance to a State or Territory; or

(g) undertaken in, or in relation to, a Territory.

Revive Live Program

To support the performance of Australian music by Australian artists, by providing funding to live music businesses, and to improve access and inclusion for people with disability at live music venues and festivals.

This objective has the effect it would have if it were limited to measures:

(a) in connection with trade and commerce with other countries, or among the States and Territories; or

(b) to give effect to Australia’s obligations under the Convention on the Rights of Persons with Disabilities, particularly Articles 4, 9 and 30; or

(c) that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or

(d) undertaken in, or in relation to, a Territory.
