This instrument is the Social Security (Assurances of Support) Amendment Determination 2024.

(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority

This instrument is made under subsection 1061ZZGH(1) of the Social Security Act 1991.

4 Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Social Security (Assurances of Support) Determination 2018

1 Section 2A

Repeal the section.

2 Paragraph 14(2)(a)

Repeal the paragraph, substitute:

(a) if:

(i) the person does not have current available evidence of assessable income for the first financial year; or

(ii) the person’s assessable income for the first financial year was reduced due to a temporary change in the person’s circumstances;

- the current financial year, and the second financial year; and

3 After paragraph 25(c)

Insert:

(ca) a body corporate that has given an assurance of support is deregistered (within the meaning of the Corporations Act 2001) and, in the opinion of the Secretary, the circumstances justify cancellation of the assurance of support;

4 Application provision

(1) The amendment made by item 2 of this Schedule applies to an assurance of support given on or after commencement of this instrument, in relation to financial years starting before, on or after that commencement.

(2) The amendment made by item 3 of the Schedule applies in relation to an assurance of support given before, on or after commencement of this instrument, in relation to deregistration that occurred before, on or after that commencement.
