Family Law (Superannuation) (Provision of Information — Public Sector Superannuation Scheme) Determination 2004 2

 

  This instrument is the Family Law (Superannuation) (Provision of Information — Public Sector Superannuation Scheme) Amendment Determination 2024.

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this instrument

The latest of the following:

(a) the day after this instrument is registered;

(b) the day after the Superannuation Amendment (PSS Trust Deed) Instrument 2024 is registered;

(c) the day after the Family Law (Superannuation) (Methods and Factors for Valuing Particular Superannuation Interests) Amendment (PSS Scheme—Preserved Benefit Members) Approval 2024 is registered.

However, the provisions do not commence at all unless both of the events mentioned in paragraphs (b) and (c) occur.

  This instrument is made under subregulation 64(7) of the Family Law (Superannuation) Regulations 2001.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

3  At the end of the instrument

Add:

  The amendments of the table in section 5 made by the Family Law (Superannuation) (Provision of Information — Public Sector Superannuation Scheme) Amendment Determination 2024 apply in relation to applications, to the trustee of the PSS Scheme for information about a superannuation interest, that:

 (a) were made before the time that instrument commences, if at that time, the trustee has not yet provided the requested information; or

 (b) are made on or after that time.
