Part 1Preliminary

1  Name

  This instrument is the Foreign Acquisitions and Takeovers Amendment (Australia-United Kingdom Free Trade Agreement Entry into Force) Instrument 2023.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under the Foreign Acquisitions and Takeovers Amendment (UK Free Trade Agreement) Regulations 2022.

4  Definitions

  In this instrument:

Agreement means the Free Trade Agreement between Australia and the United Kingdom of Great Britain and Northern Ireland, done at Adelaide on 17 December 2021 and London on 16 December 2021.

the Regulations mean the Foreign Acquisitions and Takeovers Amendment (UK Free Trade Agreement) Regulations 2022.

Part 2Announcement of entry into force of the Agreement

5  Entry into force of the Agreement

For the purposes of item 1 of the table in subsection 2(1) of the Regulations, the Agreement entered into force on 31 May 2023.

Note 1: In accordance with Article 32.7 of the Agreement, the Agreement enters into force 30 days after the date on which the Parties exchange written notifications confirming that they have completed their respective domestic requirements necessary for the entry into force of the Agreement, or on such other date as the Parties may agree. The final exchange of written notifications occurred on 30 May 2023 and the Parties agreed that the Agreement would enter into force on 31 May 2023.
