Small Pelagic Fishery (Overcatch and Undercatch) Determination 2023

The Australian Fisheries Management Authority makes the following determination in accordance with a decision made by the Commissioners under section 23 of the Fisheries Administration Act 1991.

1  Name

  This instrument is the Small Pelagic Fishery (Overcatch and Undercatch) Determination 2023.

2  Commencement

  This instrument commences on the day after registration on the Federal Register of Legislation.

3  Cessation

  This instrument ceases on 1 May 2024. 

4  Authority

  This instrument is made under paragraph 17(6)(aa) of the Act for the purpose of subsections 10(1), 29(5) and 30(3) of the Management Plan. 

5  Definitions

 (1) In this instrument:

Act means the Fisheries Management Act 1991.

Management Plan means the Small Pelagic Fishery Management Plan 2009. 

 (2) A term used in this instrument that is defined for the purposes of the Management Plan has the same meaning in this instrument as it has in that Management Plan.

Note: Terms defined in the Fisheries Management Act 1991 have the same meaning in this instrument (see paragraph 13(1)(b) of the Legislation Act 2003). 

6  Determination of overcatch and undercatch

(1)      This section applies to the 2023-24 fishing season commencing on 1 May 2023 and ending on 30 April 2024.

(2)      For a species of fish specified in an item in column 1 of the table within the sub-area of fishery specified in an item in column 2 of the table:

 (a) the determined percentage of overcatch for the purpose of subsection 29(5) of the Management Plan is determined in column 3 of the table; and

 (b) the determined percentage of undercatch for the purpose of subsection 30(3) of the Management Plan is determined in column 4 of the table; and

 (c) the determined weight, in kilograms, of overcatch for the purpose of subsection 29(5) of the Management Plan is determined in column 5 of the table.
