1  Name

  This instrument is the Petroleum and Other Fuels Reporting Amendment (Protected Information) Rules 2022.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

On the day after this instrument is registered.

3  Authority

  This instrument is made under section 41 of the Petroleum and Other Fuels Reporting Act 2017.

4  Schedules

  Each instrument that is specified in the Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

1  Part 3

Repeal the Part, substitute:

Part 3Disclosure of protected information

21  Disclosure to certain agencies

 (1) For paragraph 24(2)(c) of the Act, the following Commonwealth agencies or authorities are prescribed:

 (a) the Commonwealth agency responsible for administering one or more of:

 (i) Part VIII of the Customs Act 1901; or

 (ii) the Security of Critical Infrastructure Act 2018; or

 (iii) the National Emergency Declaration Act 2020;

Note:  In July 2022, this is the Department of Home Affairs.

 (b) the Australian Border Force, as established by the Australian Border Force Act 2015;

  (c) the Commonwealth agency responsible for administering the Defence Act 1903, other than Part IIIAAA;

Note:  In July 2022, this is the Department of Defence.

 (d) the Commonwealth agency responsible for administering the Offshore Petroleum and Greenhouse Gas Storage Act 2006;

Note:  In July 2022, this is the Department of Industry, Science and Resources.

 (e) the Commonwealth agency responsible for administering the Fuel Security Act 2021;

Note:  In July 2022, this is the Department of Climate Change, Energy, the Environment and Water.

 (f) the Department of Prime Minister and Cabinet;

 (g) the Clean Energy Regulator.

 (2) For paragraph 24(2)(d) of the Act, the following State and Territory government agencies are prescribed:

 (a) the Australian Capital Territory government agency responsible for administering the Fuels Rationing Act 2019 (ACT) as in force from time to time;

Note: In July 2022, this is the Environment, Planning and Sustainable Development Directorate.

 (b) the New South Wales State government agency responsible for administering Part 6 of the Energy and Utilities Administration Act 1987 (NSW) as in force from time to time;

Note:  In July 2022, this is the New South Wales Treasury.

 (c) the Northern Territory government agency responsible for administering the Essential Goods and Services Act 1981 (NT) as in force from time to time;

Note:  In July 2022, this is the Department of the Chief Minister and Cabinet.

  (d) the Queensland State government agency responsible for administering the Liquid Fuel Supply Act 1984 (Qld) as in force from time to time;

Note:  In July 2022, this is the Department of Energy and Public Works.

 (e) the South Australian State government agency responsible for administering the Petroleum Products Regulation Act 1995 (SA) as in force from time to time;

Note:  In July 2022, this is the Department of Treasury and Finance.

 (f) the Tasmanian State government agency responsible for administering the Petroleum Products Emergency Act 1994 (Tas) as in force from time to time;

Note:  In July 2022, this is the Department of Treasury and Finance.

 (g) the Victorian State government agency responsible for administering the Fuel Emergency Act 1977 (Vic) as in force from time to time;

Note:  In July 2022, this is the Department of Environment, Land, Water and Planning.

 (h) the Western Australian State government agency responsible for administering Part III of the Fuel, Energy and Power Resources Act 1972 (WA) as in force from time to time.

Note:  In July 2022, this is Energy Policy WA.
