1  Name

  This instrument is the Public Governance, Performance and Accountability Amendment (National Recovery and Resilience Agency) Rules 2021.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under the Public Governance, Performance and Accountability Act 2013.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

Part 1Amendments commencing day after registration

Public Governance, Performance and Accountability Rule 2014

1  Clause 15A of Schedule 1 (heading)

Repeal the heading, substitute:

15A  National Recovery and Resilience Agency

2  Subparagraph 15A(a)(i) of Schedule 1

Omit “National Drought and North Queensland Flood Response and Recovery Agency”, substitute “National Recovery and Resilience Agency”.

3  Paragraph 15A(b) of Schedule 1

Omit “National Drought and North Queensland Flood Response and Recovery Agency”, substitute “National Recovery and Resilience Agency”.

4  Paragraph 15A(e) of Schedule 1

Repeal the paragraph, substitute:

 (e) the purposes of the listed entity include the following:

 (i) to design, develop, consult on, coordinate and, where appropriate, deliver, relief, longterm recovery and reconstruction for areas affected by allhazard disasters, including the 2019 North Queensland monsoon trough, the 201920 bushfires and the 2021 New South Wales and Queensland floods;

 (ii) to provide advice to the responsible Minister for the entity, and where necessary the Prime Minister, on how existing and new Commonwealth policies and programs can best contribute to relief, recovery and reconstruction efforts in areas affected by allhazard disasters;

 (iii) to engage with communities affected by allhazard disasters to support locallyled recovery and improve awareness and uptake of Commonwealth relief, recovery and reconstruction support;

 (iv) to administer the Commonwealth loan scheme to provide assistance to eligible primary producers by way of loans to authorised deposittaking institutions (within the meaning of the Banking Act 1959) at the Commonwealth’s cost of borrowing;

 (v) to work closely with all levels of government to continually improve national disaster recovery and resilience coordination;

 (vi) to coordinate and oversee the Commonwealth’s drought response;

 (vii) to provide advice to the responsible Minister for the entity on matters relevant to the entity;

 (viii) to undertake other relevant tasks as the responsible Minister for the entity may require from time to time.

Part 2Amendments commencing 1 July 2021

Public Governance, Performance and Accountability Rule 2014

5  Subparagraphs 15A(e)(vi) to (viii) of Schedule 1

Repeal the subparagraphs, substitute:

 (vi) to provide national leadership and strategic coordination for natural disaster resilience, risk reduction and preparedness, and allhazards disaster relief and recovery across all levels of government and sectors;

 (vii) to lead national implementation of the National Disaster Risk Reduction Framework and relevant action plans;

 (viii) to develop, lead and coordinate national disaster recovery policy, including funding arrangement policy and reforms;

 (ix) to design, oversee and administer natural disaster resilience, risk reduction and preparedness funding programs, including but not limited to the Emergency Response Fund Special Account;

 (x) to administer the Disaster Recovery Funding Arrangements 2018 and hold policy responsibility for the Australian Government Disaster Recovery Payment, the Disaster Recovery Allowance, the Pandemic Leave Disaster Payment, and equivalent exgratia payments for New Zealand citizens;

 (xi) to provide strategic oversight of the Australian Institute for Disaster Resilience and other relevant national research centres;

 (xii) to work with all levels of government to enhance national disaster recovery capability and preparedness and improve local disaster resilience capacity;

 (xiii) to administer the Rural Financial Counselling Service and related measures;

 (xiv) to deliver drought recovery and resilience outreach and community engagement;

 (xv) to provide advice to the responsible Minister for the entity on matters relevant to the entity;

 (xvi) to undertake other relevant tasks as the responsible Minister for the entity may require from time to time.
