1  Name

  This instrument is the Social Security (Assurances of Support) Amendment Determination 2021.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under section 1061ZZGH of the Social Security Act 1991.

  Each instrument that is specified in Schedule 1 to this instrument is amended or repealed as set out in the applicable items in the Schedule, and any other item in Schedule 1 to this instrument has effect according to its terms.

Social Security (Assurances of Support) Determination 2018

1  Section 2A

Omit “31 March 2021”, substitute “31 March 2024”.

2  Subsection 5(1), definition of rate of newstart allowance

Omit “newstart allowance” (wherever occurring), substitute “jobseeker payment”.

3  Subsection 6(1) (table item 5)

Omit “Newstart allowance”, substitute “Jobseeker payment”.

4  Paragraph 15(2)(a)

Omit “newstart allowance”, substitute “jobseeker payment”.

5  Subection 15(2), example

Omit the example under subsection 15(2), substitute:

Example

If a person with two children applies to give an assurance of support for a migrating family of two parents and two children on 1 July 2020, the minimum required income amount of the person is the total of:

          $47,736 (the applicable annual rate of jobseeker payment, $15,912, multiplied by the total number of the adult assurer and adult assurees (three)), plus

          $4,737.70 (the base FTB child rate and the applicable supplement amount of $2,368.85 multiplied by the total number of the assurers children (two)).

No multiple of the base FTB child rate and the applicable supplement amount is included in the calculation of income requirement on account of the assureeschildren. 

6  Paragraph 16(2)(a)

Omit “newstart allowance”, substitute “jobseeker payment”.

7  Subsection 16(2), example

Omit the example under subsection 16(2), substitute:

Example

If a person with a partner and two children applies to give an assurance of support jointly with their partner for a migrating family of two parents and two children on 1 July 2020, the combined minimum required income of both the person and their partner is the total of: 

          $63,648 (the applicable annual rate of jobseeker payment, $15,912, multiplied by the total number of adult assurers and adult assurees (four)), and

          $4,737.70 (the base FTB child rate and the applicable supplement amount of $2,368.85 multiplied by the total number of the assurers' children (two)).

No multiple of the base FTB child rate and the applicable supplement amount is included in the calculation of income requirement on account of the assurees’ children. 

8  Paragraphs 20(1)(a) and (b)

Repeal the paragraphs, substitute:

(a)        if the assurance is for 10 years — $20,000;

(b)       in any other case $10,000.

9  Application provision

The amendment made by item 8 of this Schedule applies to an assurance of support given under Chapter 2C of the Social Security Act 1991 on or after the commencement of this instrument.
