DECLARATION OF AN APPROVED WILDLIFE TRADE MANAGEMENT PLAN – CROCODILE FARMING IN THE NORTHERN TERRITORY 2021–25

 

I, Laura Timmins, Senior Director of the Wildlife Trade Office, as Delegate of the Minister for the Environment being satisfied as to the matters set out in section 303FO of the EPBC Act, declare that the Wildlife Trade Management Plan – Crocodile Farming in the Northern Territory 2021–25 (the Plan) is an approved wildlife trade management plan for the purposes of section 303FO of the Environment Protection and Biodiversity Conservation Act 1999.

Unless amended or revoked, this declaration:

(a)      is valid for five years from the day after the date of registration on the Federal Register of Legislation; and

(b)      has effect subject to the following conditions applied under section 303FT:

  1. Commercial farming of crocodiles in the Northern Territory must be conducted in accordance with the Wildlife Trade Management Plan- Crocodile Farming in the Northern Territory 2021 – 2025 (the Plan).
  2. The Northern Territory Department of Environment, Parks and Water Security must inform the Department of any intended changes to management arrangements for the commercial farming of crocodiles in the Northern Territory that may affect the assessment against which EPBC Act decisions have been made.
  3. The annual report referred to in section 3.4 of the Plan must be submitted to the Department of Agriculture, Water and the Environment by 30 June each year. The annual report will cover the previous calendar year.

A person whose interests are affected by this declaration may, within 28 days, make an application in writing to the Department of Agriculture, Water and the Environment for the reasons for the decision.

An application for independent review of the decision (under section 303GJ(1) of the Environment Protection and Biodiversity Conservation Act 1999) may be made to the Administrative Appeals Tribunal (AAT), on payment of the relevant fee (currently $884 or reduced fee where applicable due to financial hardship) by the applicant, either within 28 days of receipt of the reasons for the decision, or within 28 days of this declaration if reasons for the decision are not sought.
