Part 1—Preliminary

1  Name

(1)           This instrument is the Telecommunications (Interception and Access) (Communications Access Co-ordinator) Instrument 2019.

(2)           This instrument may be cited as LIN 19/028.

2  Commencement

  This instrument commences the day after it is registered on the Federal Register of Legislation.

3  Authority

  This instrument is made under subsection 6R(2) of the Telecommunications (Interception and Access) Act 1979 and subsection 33(3) of the Acts Interpretation Act 1901.

4  Definitions

In this instrument:

Act means the Telecommunications (Interception and Access) Act 1979.

Classification Rules means the Public Service Classification Rules 2000.

EL1 means an Executive Level 1 classification under the Classification Rules.

EL2 means an Executive Level 2 classification under the Classification Rules.

Policy Group means the Policy Group in the Department of Home Affairs.

Security and Resilience Group means the Security and Resilience Group in the Department of Home Affairs.

SES1 means a Senior Executive Band 1 classification under the Classification Rules.

SES2 means a Senior Executive Band 2 classification under the Classification Rules.

SES3 means a Senior Executive Band 3 classification under the Classification Rules.

Part 2—Communications Access Co-ordinator

5  Specification of persons

  For the purposes of subsection 6R(2) of the Act, a person who holds, occupies or performs the duties of a position at the classification level and in the work area of the Department of Home Affairs mentioned in paragraphs (a) to (f) is specified for the purposes of paragraph (b) of the definition of Communications Access Co-ordinator in subsection 6R(1) of the Act:

(a)                     in the National Security Policy Branch of the National Security and Law Enforcement Policy Division of the Policy Group –

(i)                  EL1; or

(ii)               EL2; or

(iii)             SES1;

(b)                    in the National Security and Law Enforcement Policy Division of the Policy Group – SES2;

(c)                     in the Policy Group – SES3;

(d)                    in the Telecommunications and Technology Branch of the Critical Infrastructure Security Division of the Security and Resilience Group –

(i)                  EL1; or

(ii)               EL2; or

(iii)             SES1;

(e)                     in the Critical Infrastructure Security Division of the Security and Resilience Group – SES2;

(f)                      in the Security and Resilience Group – SES3.

Part 3—Repeal

6  Repeal of instrument

The Telecommunications (Interception and Access) (Communications Access Co-ordinator) Instrument 2018 is repealed.
