Biosecurity (Human Biosecurity Emergency) (Human Coronavirus with Pandemic Potential) (Emergency Requirements—Retail Outlets at International Airports) Determination 2020
This instrument is the Biosecurity (Human Biosecurity Emergency) (Human Coronavirus with Pandemic Potential) (Emergency Requirements—Retail Outlets at International Airports) Amendment (No. 1) Determination 2020.
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under subsection 477(1) of the Biosecurity Act 2015.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
1 Section 4
Insert:
international transit passenger means a person who:
(a) is in transit between places outside Australia; and
(b) is at a designated international airport during that transit (including a person who has exited and re‑entered the airport in accordance with hotel quarantine arrangements in the State or Territory in which the airport is located).
2 Before subsection 5(2)
Insert:
Exemption of pharmacies
3 Subsections 5(3) and (4)
Repeal the subsections, substitute:
Exemption of designated retail outlets in departure areas
(3) A designated retail outlet that is in the departure area of:
(a) an international terminal referred to in paragraph (a) of the definition of international area in section 4; or
(b) a terminal referred to in paragraph (b) of that definition;
is exempt from the requirement under subsection (1).
Conditions on exemptions
(4) An exemption under subsection (2) or (3) applies in relation to a designated retail outlet only if the operator of the retail outlet has put in place and maintains:
(a) measures to ensure social distancing among its customers; and
(b) measures to minimise the risk of transmission of human coronavirus with pandemic potential from international transit passengers.
4 Subsection 6(3)
Repeal the subsection, substitute:
(3) An exemption granted under subsection (1) applies in relation to a designated retail outlet only if the operator of the retail outlet has put in place and maintains:
(a) measures to ensure social distancing among its customers; and
(b) measures to minimise the risk of transmission of human coronavirus with pandemic potential from international transit passengers.
