Schedule 1—Amendments

Carbon Credits (Carbon Farming Initiative) Regulations 2011

1  Name

  This instrument is the Carbon Credits (Carbon Farming Initiative) Amendment (Excluded Offsets Projects) Regulations 2020.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under the Carbon Credits (Carbon Farming Initiative) Act 2011.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Carbon Credits (Carbon Farming Initiative) Regulations 2011

1  Regulation 1.3 (note to the definition of CFI rainfall map)

Repeal the note.

2  Regulation 3.34 (subparagraph (b)(i) of the definition of known weed species)

Omit “Noxious Weeds Act 1993”, substitute “Biosecurity Act 2015”.

3  Regulation 3.34 (subparagraph (b)(iii) of the definition of known weed species)

Omit “Land Protection (Pest and Stock Route Management) Act 2002”, substitute “Biosecurity Act 2014”.

4  Regulation 3.34 (subparagraph (b)(iv) of the definition of known weed species)

Omit “Plant Diseases Act 1914”, substitute “Biosecurity and Agriculture Management Act 2007”.

5  Regulation 3.34 (note to the definition of known weed species)

Repeal the note.

6  Regulation 3.34 (note to the definition of Salinity Guidelines)

Repeal the note.

7  Paragraph 3.36(1)(d)

Repeal the paragraph.

8  After subregulation 3.37(4)

Insert:

 (4A) Specified tree planting is not an excluded offsets project if the project area is in a region specified in writing that:

 (a) specifies one or more regions each of which:

 (i) is within an area that, according to the CFI rainfall map, receives more than 600 mm long‑term average annual rainfall; and

 (ii) is a region in which the planting of trees is unlikely to have a material adverse impact on the availability of water; and

 (b) is published on the Department’s website;

as the writing exists from time to time.
