Part 1—Introduction

1  Name

 (1) This instrument is the Migration (LIN 19/260: Assessing Authorities for Subclass 494 Visas) Instrument 2019.

 (2) This instrument may be cited as LIN 19/260.

3  Authority

  This instrument is made under subregulation 2.26B(1) of the Migration Regulations 1994.

4  Definitions

  In this instrument:

Medium and Longterm Strategic Skills List: see subsection 6(1).

nec (short for not elsewhere classified), in relation to an occupation, has the same meaning as in ANZSCO.

Regional Occupation List: see subsection 7(1).

Regulations means the Migration Regulations 1994.

university lecturer includes the following:

 (a) a research associate in a university;

 (b) a research fellow in a university.


Part 2—Assessing authorities

5  Relevant assessing authorities

  For the purposes of subregulation 2.26B(1) of the Regulations, a person or body mentioned in column 2 of an item of the Medium and Long term Strategic Skills List or the Regional Occupation List is specified as the relevant assessing authority for:

 (a) the occupation; and

 (b) all countries;

for the purposes of an application for a skills assessment made by a resident of one of those countries.

10  Amendments made by the Migration (Assessing Authorities for Subclass 494 Visas) Amendment Instrument (LIN 22/054) 2022

New assessing authorities specified for visa applications made on or after commencement regardless of when application for assessment is made

 (1) The amendments of this instrument made by Schedule 1 to the Migration (Assessing Authorities for Subclass 494 Visas) Amendment Instrument (LIN 22/054) 2022 (the amending instrument) apply in relation to an application for a Subclass 494 (Skilled Employer Sponsored Regional (Provisional)) visa:

 (a) if the application is made on or after the day the amending instrument commences; and

 (b) regardless of whether the application for the skills assessment for the purposes of paragraph 1242(5)(a) of Schedule 1 or paragraph 494.224(2)(a) or subparagraph (4)(a)(iii) of Schedule 2 to the Regulations was made before, on or after that day.

Previous assessing authorities also specified for visa applications made on or after commencement if application for assessment is made before commencement

 (2) For the purposes of subsection 494.224(6) of Schedule 2 to the Regulations, a person or body listed in column 2 of an item of the following table is also specified as the assessing authority for the occupation listed in column 1 of the item in relation to an application for a Subclass 494 (Skilled Employer Sponsored Regional (Provisional)) visa if:

 (a) the application for the visa is made on or after the day the amending instrument commences; and

 (b) the application for the skills assessment for the purposes of paragraph 1242(5)(a) of Schedule 1 or paragraph 494.224(2)(a) or subparagraph (4)(a)(iii) of Schedule 2 to the Regulations was made before the day the amending instrument commences.
