Imported Food Control (Recordkeeping) Determination 2019 i

 

1 Name

This instrument is the Imported Food Control (Recordkeeping) Determination 2019.

2 Commencement

This instrument commences the day after it is registered.
3 Authority

This instrument is made under subsection 28(2) of the Imported Food Control Act 1992.

4 Definitions

Note: A number of expressions used in this instrument are defined in the Act, including the following:

(a)     food;

(b)     owner.

In this instrument:

Act means the Imported Food Control Act 1992.

batch has the same meaning as in the Regulations.

lot has the same meaning as in the Regulations.

Regulations means the regulations made under the Act.
5 Information that must be contained in records

(1) If food to which the Act applies is imported into Australia, the owner of the food at the time of importation (the owner) must keep records containing the following information:

(a) the contact details specified in subsection (2) for:

(i)             the producer of the food; and

(ii)           the person or persons to whom the owner dispatches the food;

(b) one or more of the contact details specified in subsection (3) for each of the persons mentioned in paragraph (a), but only if these contact details are known to the owner;

(c) a name or a description of the food that is sufficient to indicate the true nature of the food;

(d) both of the following dates:

(i) the date that the food was received by the owner from the producer or supplier of the food;

(ii) the date that the food is dispatched by the owner to each person to whom

the owner dispatches it;

(e) one of the following as it applies to the food:

(i)     lot code; and

(ii)   batch code;

(f) the volume or quantity of the food that is dispatched by the owner to each

person to whom the owner dispatches it;

(2) For paragraph (1)(a), the following contact details are specified:

(a)    the name of the person; and

(b)    any business name used by the person; and

(c)    the person’s street address;

(3) For paragraph (1)(b), the following contact details are specified:

(a)    the person’s telephone number; and

(b)    the person’s email address.
