1  Name

  This instrument is the Product Grants and Benefits Administration Regulations 2019.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under the Product Grants and Benefits Administration Act 2000.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

5  Definitions

  In this instrument:

Act means the Product Grants and Benefits Administration Act 2000.

authority includes a Department or agency of the Commonwealth, or of a State or Territory.

6  Requirements for registration for entitlement to product stewardship (oil) benefits

  For the purposes of paragraph 9(3A)(b) of the Act, the following must be satisfied:

 (a) an applicant must comply with relevant Commonwealth, State and Territory legislation relating to oil recycling operations or enterprises;

 (b) the Commissioner must not have been informed, by an authority responsible for the administration of any of the legislation mentioned in paragraph (a), that the applicant does not comply with that legislation.
