CASA EX101/19 — Helicopter Aerial Application Endorsements Exemption 2019

1                     Name

This instrument is CASA EX101/19 — Helicopter Aerial Application Endorsements Exemption 2019.

2 Duration

 This instrument:

(a) commences on 1 September 2019; and

(b) is repealed at the end of 31 August 2022.

3 Definitions

Note   In this instrument certain terms and expressions have the same meaning as they have in the Civil Aviation Act 1988 and the regulations, including CASR.

 In this instrument:

aerial application endorsement has the meaning given by regulation 61.010 of CASR.

aerial application operation has the meaning given by regulation 61.010 of CASR.

dual flight has the meaning given by regulation 61.010 of CASR.

helicopter aerial application endorsement means the endorsement set out in item 2 of table 61.1120 of CASR.

relevant requirement means the requirement to have at least 15 hours of dual flight in a helicopter while receiving training in aerial application operations, as set out in column 3 of item 2 of table 61.1120 of CASR.

4 Exemptions

 (1)Subsection (2) applies to a person who applies for the grant of an aerial application rating based on meeting the requirements set out in regulation 61.1140 of CASR for the grant of a helicopter aerial application endorsement.

 (2)For the purposes of paragraph 61.1115 (1) (b) of CASR, the person is exempt from compliance with the relevant requirement, if the person has the aeronautical experience mentioned in subsection (4).

 (3)For the purposes of paragraph 61.1140 (1) (b) of CASR, a person who applies for the grant of a helicopter aerial application endorsement is exempt from compliance with the relevant requirement, if the person has the aeronautical experience mentioned in subsection (4).

 (4)For subsection (2) and (3), the person must have at least 10 hours of dual flight in a helicopter while receiving training in aerial application operations.

5 Condition

 (1)This condition applies if the person:

(a) is granted the rating referred to in subsection 4 (1) or the endorsement referred to in subsection 4 (3); and

(b) is not relying on the criterion set out in paragraph 61.1130 (1) (a) of CASR for the exercise of the privileges of the rating or endorsement.

(2) The person must ensure that, in addition to the 10 hours of direct supervision required by paragraph 61.1130 (2) (a) of CASR, at least 10 hours of the supervision set out in paragraph 61.1130 (2) (b) of CASR are also direct supervision.
