Public Governance, Performance and Accountability (Section 75 Transfers) Determination 2018‑2019
This instrument is the Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 2018-2019 (No. 7).
This instrument commences on the day after it is registered.
This instrument is made under section 75 of the Public Governance, Performance and Accountability Act 2013.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
Public Governance, Performance and Accountability (Section 75 Transfers) Determination 2018‑2019
1 Section 4 (at the end of the definition of Appropriation Act)
Add:
; or (c) the Appropriation Act (No. 3) 2018‑2019; or
(d) the Appropriation Act (No. 4) 2018‑2019.
2 Section 5
Repeal the item, substitute:
(1) The Appropriation Acts have effect as if:
(a) references in the Schedules to the Acts to the Agriculture and Water Resources Portfolio were references to the Agriculture Portfolio; and
(b) references in the Schedules to the Acts to the Department of Agriculture and Water Resources were references to the Department of Agriculture; and
(c) references in the Schedules to the Acts to the Education and Training Portfolio were references to the Education Portfolio; and
(d) references in the Schedules to the Acts to the Department of Education and Training were references to the Department of Education; and
(e) references in the Schedules to the Acts to the Department of Human Services were references to Services Australia; and
(f) references in the Schedules to the Acts to:
(i) the Jobs and Innovation Portfolio; or
(ii) the Jobs and Small Business Portfolio;
were references to the Employment, Skills, Small and Family Business Portfolio; and
(g) references in the Schedules to the Acts to the Department of Jobs and Small Business were references to the Department of Employment, Skills, Small and Family Business; and
(h) references in the Schedules to the Acts to the Infrastructure, Regional Development and Cities Portfolio were references to the Infrastructure, Transport, Cities and Regional Development Portfolio; and
(i) references in the Schedules to the Acts to the Department of Infrastructure, Regional Development and Cities were references to the Department of Infrastructure, Transport, Cities and Regional Development.
(2) Assuming that the substitutions described in subsection (1) have happened, the Appropriation Acts have effect as if:
(a) items and outcomes for the Australian Skills Quality Authority, included for the Education Portfolio, were instead included for the Employment, Skills, Small and Family Business Portfolio; and
(b) items and outcomes for the Digital Transformation Agency, included for the Prime Minister and Cabinet Portfolio, were instead included for the Social Services Portfolio; and
(c) items and outcomes for Services Australia, included for the Human Services Portfolio, were instead included for the Social Services Portfolio; and
(d) items and outcomes for the following entities, included for the Employment, Skills, Small and Family Business Portfolio, were instead included for an Industry, Innovation and Science Portfolio:
(i) Department of Industry, Innovation and Science;
(ii) Australian Institute of Marine Science;
(iii) Australian Nuclear Science and Technology Organisation;
(iv) Commonwealth Scientific and Industrial Research Organisation;
(v) Northern Australia Infrastructure Facility;
(vi) Geoscience Australia;
(vii) IP Australia; and
(e) items and outcomes for the following entities, included for the Employment, Skills, Small and Family Business Portfolio, were instead included for the Attorney-General’s Portfolio:
(i) Asbestos Safety and Eradication Agency;
(ii) Australian Building and Construction Commission;
(iii) Fair Work Commission;
(iv) Fair Work Ombudsman and Registered Organisations Commission Entity;
(v) Safe Work Australia;
(vi) Comcare; and
(f) items and outcomes for the Australian Security Intelligence Organisation, included for the Attorney-General’s Portfolio, were instead included for the Home Affairs Portfolio; and
(g) items and outcomes for the following entities, included for the Prime Minister and Cabinet Portfolio, were instead included for the Attorney-General’s Portfolio:
(i) Office of the Commonwealth Ombudsman;
(ii) Office of the Inspector-General of Intelligence Services.
3 Subsection 6(1)
Repeal the subsection, substitute:
(1) This section applies to the Appropriation Act (No. 1) 2018‑2019.
(1A) For the purposes of this section, assume that the substitutions described in section 5 have happened.
4 Subsection 6(4) (table item 10)
Repeal the item, substitute:
