  This instrument is the Competition and Consumer (Price Notifications—Aeronautical Services to NSW Regional Airlines) Declaration 2019.

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  This instrument is made under the Competition and Consumer Act 2010.

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

  In this instrument:

ABN has the meaning given by the A New Tax System (Australian Business Number) Act 1999.

the Act means the Competition and Consumer Act 2010.

Note: Expressions have the same meaning in this instrument as in the Act as in force from time to time—see paragraph 13(1)(b) of the Legislation Act 2003.

 

  For the purposes of Part VIIA of the Act, services consisting of the provision of aeronautical services and facilities (within the meaning of Part 7 of the Airports Regulations 1997) to regular public transport air services, operating wholly within the State of New South Wales, are declared to be notified services.

Note: Under subsection 95X(1) of the Act, the Minister may declare goods and services of a specified description to be notified goods and services for the purposes of Part VIIA of the Act (about prices surveillance).

  For the purposes of Part VIIA of the Act, Sydney Airport Corporation Limited (ABN 62 082 578 809) is declared to be a declared person in relation to services that are both:

 (a) notified services because of section 6; and

 (b) provided at the airport known as Sydney (Kingsford-Smith) Airport.

Note: Under subsection 95X(2) of the Act, the Minister may declare a person to be, in relation to goods and services of a specified description, a declared person for the purposes of Part VIIA of the Act (about prices surveillance).

 

  This instrument ceases to have effect on 30 June 2022.

Note: Under subsection 95X(4) of the Act, the Minister must specify the time when this instrument is to cease to have effect.
