Part 1—Introduction

1  Name

  This instrument is the Migration (LIN 19/051: Specification of Occupations and Relevant Assessing Authorities) Instrument 2019.

3  Authority

  This instrument is made under the following provisions of the Migration Regulations 1994:

 (b) subregulation 1.15I(1);

 (c) subregulation 2.26B(1);

 (d) subitem 1137(4C) of Schedule 1;

 (e) item 4 of the table in subitem 1138(4) of Schedule 1;

 (f) paragraph 1229(3)(k) of Schedule 1;

 (g) subitem 1241(5) of Schedule 1.

4  Definitions

 Note: A number of expressions used in this instrument are defined in the Regulations, including skilled occupation.

  In this instrument:

applicable list: see subsection 7(2).

Medium and Longterm Strategic Skills List: see subsection 8(1).

nec is short for not elsewhere classified.

Regional Occupation List: see subsection 10(1).

Regulations means the Migration Regulations 1994.

Shortterm Skilled Occupation List: see subsection 9(1).

university lecturer includes the following:

 (a) a research associate in a university;

 (b) a research fellow in a university.


Part 2—Specification of occupations and relevant assessing authorities

7  Specification of occupations

Application

 (1) This section applies to a class of persons mentioned in column 1 of an item of the following table:

(a) persons who are issued an invitation to make an application for a Subclass 189 (Skilled—Independent) visa on or after the day this instrument commences; and

(b) persons who:

(i) are not nominated by a State or Territory government agency; and

(ii) are issued an invitation to make an application for a Subclass 491 (Skilled Work Regional (Provisional)) visa; and

(c) spouses or de facto partners of persons to whom paragraph (a) or (b) applies

persons who apply for a Subclass 485 (Temporary Graduate) visa on or after the day this instrument commences

(a) persons who:

(i) are nominated by a State or Territory government agency; and

(ii) are issued an invitation to make an application for a Subclass 190 (Skilled—Nominated) visa on or after the day this instrument commences; and

(b) spouses or de facto partners of persons to whom paragraph (a) applies; and

(c) persons who:

(i) are the spouses or de facto partners of persons who are nominated by a State or Territory government agency; and

(ii) are issued an invitation to make an application for a Subclass 190 (Skilled—Nominated) visa on or after the day this instrument commences

(a) Medium and Longterm Strategic Skills List; and

(b) Shortterm Skilled Occupation List

(a) persons who:

(i) are nominated by a State or Territory government agency; and

(ii) are issued an invitation to make an application for a Subclass 491 (Skilled Work Regional (Provisional)) visa; and

(b) spouses or de facto partners of persons to whom paragraph (a) applies; and

(c) persons who:

(i) are the spouses or de facto partners of persons who are nominated by a State or Territory government agency; and

(ii) are issued an invitation to make an application for a Subclass 491 (Skilled Work Regional (Provisional)) visa

(a) Medium and Longterm Strategic Skills List; and

(b) Shortterm Skilled Occupation List; and

(c) Regional Occupation List

Meaning of applicable list

 (2) A list mentioned in column 2 of the item is an applicable list for the class of persons.

Specification of occupations

 (3) For the purposes of paragraph 1.15I(1)(a) of the Regulations, each occupation mentioned in column 1 of an item of an applicable list for the class is specified to be a skilled occupation for the class.

 (4) For the purposes of paragraph 1.15I(1)(c) of the Regulations, each occupation is applicable to each member of the class.

 (5) For the purposes of subitem 1137(4C) of Schedule 1 to the Regulations, if table item 1 of the table in subsection (1) of this section applies, each occupation is specified as a skilled occupation for the purposes of table item 4 of the table in subitem 1137(4B) of Schedule 1 to the Regulations.

 (6) Each occupation is also specified as a skilled occupation:

 (a) if item 1 of the table in subsection (1) of this section applies—for the purposes of subitem 1241(5) of Schedule 1 to the Regulations; or

 (b) if item 2 of the table in subsection (1) of this section applies—for the purposes of paragraph 1229(3)(k) of Schedule 1 to the Regulations; or

 (c) if item 3 of the table in subsection (1) of this section applies—for the purposes of item 4 of the table in subitem 1138(4) of Schedule 1 to the Regulations; or

 (d)  if item 4 of the table in subsection (1) of this section applies—for the purposes of subitem 1241(5) of Schedule 1 to the Regulations.

 (7) However, if a circumstance mentioned in subsection 8(2) for an item in the Medium and Longterm Strategic Skills List applies to the item mentioned in that subsection, then the occupation mentioned in column 1 of that item does not apply to a person mentioned in subsection (1).

12  Application of this instrument

  This instrument applies in relation to the following:

 (a) each person included in a class of persons mentioned in column 1 of items 1, 3 and 4 of the table in subsection 7(1), if the invitation mentioned in those items is issued on or after the day this instrument commences;

 (b) a person included in the class of persons mentioned in column 1 of item 2 of the table in subsection 7(1), if the visa application mentioned in that item is made by that person on or after the day this instrument commences.

13  Continued application of IMMI 18/051

  Despite the repeal of the Migration (IMMI 18/051: Specification of Occupations and Assessing Authorities) Instrument 2018 (the repealed instrument) by this instrument, the repealed instrument, as in force immediately before the day this instrument commences, continues to apply in relation to the following:

 (a) each person included in a class of persons mentioned in column 1 of items 1, 3 and 4 in the table in subsection 7(1) of the repealed instrument, if the invitation mentioned in those items is issued:

 (i) on or after 18 March 2018; but

 (ii) before the day this instrument commences;

 (b) a person included in the class of persons mentioned in column 1 of item 2 of the table in subsection 7(1) of the repealed instrument, if the visa application mentioned in that item is made by the person:

 (i) on or after 18 March 2018; but

 (ii) before the day this instrument commences.

14  Application of amendments made by Schedule 1 to LIN 19/243

  The amendments made by Part 1 of Schedule 1 to LIN 19/243:

 (a) apply in relation to an application for a Subclass 491 (Skilled Work Regional (Provisional)) visa made on or after 16 November 2019; and

 (b) do not apply in relation to an application for a Subclass 489 (Skilled—Regional (Provisional)) visa made before 16 November 2019.

15  Amendments made by the Migration (Specification of Occupations and Assessing Authorities) Amendment Instrument (LIN 22/053) 2022

 (1) This section applies to an application for:

 (a) a Subclass 189 (Skilled—Independent) visa; or

 (b) a Subclass 190 (Skilled—Nominated) visa; or

 (c) a Subclass 485 (Temporary Graduate) visa; or

 (d) a Subclass 491 (Skilled Work Regional (Provisional)) visa;

made on or after the day (the commencement day) the Migration (Specification of Occupations and Assessing Authorities) Amendment Instrument (LIN 22/053) 2022 commences.

New assessing authorities specified for visa applications made on or after commencement day regardless of when application for skills assessment is made

 (2) The amendments of this instrument made by Schedule 1 to the Migration (Specification of Occupations and Assessing Authorities) Amendment Instrument (LIN 22/053) 2022 apply in relation to an application for a visa to which this section applies, whether the application for the skills assessment in relation to the application for the visa was made before, on or after the commencement day.

Previous assessing authorities also specified for visa applications made on or after commencement day if application for skills assessment is made before commencement day

 (3) For the purposes of subregulation 2.26B(1) of the Regulations, a person or body listed in column 2 of an item of the following table is also specified as the relevant assessing authority for:

 (a) the skilled occupation listed in column 1 of the item; and

 (b) all countries;

for the purposes of an application for a skills assessment made by a resident of one of those countries in relation to an application for a visa to which this section applies, if the application for the skills assessment is made before the commencement day.

  The amendments of this instrument made by Schedule 7 to the Migration Amendment (Relevant Assessing Authorities and Other Matters) Instrument 2024 (LIN 24/083) apply in relation to an application made in response to an invitation given by the Minister on or after the commencement of that Schedule.
