CASA 58/18  Flight Training (Approved Pilots under Civil Aviation Order 29.10  Mustering) Approval 2018

1 Name

 This instrument is CASA 58/18  Flight Training (Approved Pilots under Civil Aviation Order 29.10 – Mustering) Approval 2018.

2 Duration

 (1)This instrument commences on 1 September 2018.

 (2)Subject to subsection (3), this instrument is repealed at the end of 31 August 2021.

 (3) Despite the repeal of this instrument by subsection (2), subsection 6 (2) continues in force until the end of 31 August 2028 as if the instrument had not been repealed.

3 Definitions

 In this instrument:

approved person means a person mentioned in section 4 of this instrument who, in reliance on this instrument, conducts Part 141 flight training mentioned in section 5.

approved to act as an approved pilot means approved under subsection 12 of Civil Aviation Order 29.10, as in force at the time the approval was granted, to act as an approved pilot.

Note   Civil Aviation Order 29.10 has been amended and no longer provides for approved pilots.

valid instructor proficiency check has the same meaning as in regulation 61.1180 of CASR, as in force from time to time.

Note   The requirements and standards for an instructor proficiency check are set out in Appendix 5 of Schedule 6 of the Part 61 Manual of Standards.

4 Application

 (1)This instrument applies to a person who:

(a) on 31 August 2014, was approved to act as an approved pilot in an aeroplane; and

(b) has a valid instructor proficiency check that included a test of competency of the aeroplane lowlevel rating training endorsement.

 (2)This instrument also applies to a person who:

(a) on 31 August 2014, was approved to act as an approved pilot in a helicopter; and

(b) has a valid instructor proficiency check that included a test of competency of the helicopter lowlevel rating training endorsement.

5 Approval

 (1)A person mentioned in subsection 4 (1) is approved to conduct Part 141 flight training for the grant under Part 61 of CASR of each of the following:

(a) a lowlevel rating;

(b) an aeroplane lowlevel endorsement;

(c) an aerial mustering aeroplane endorsement.

 (2)A person mentioned in subsection 4 (2) is approved to conduct Part 141 flight training for the grant under Part 61 of CASR of each of the following:

(a) a lowlevel rating;

(b) a helicopter lowlevel endorsement;

(c) an aerial mustering helicopter endorsement.

 (3)An approval is subject to the conditions mentioned in section 6.

6 Conditions

 (1) The approved person must ensure that the Part 141 flight training complies with the relevant requirements and standards, for the rating or endorsement, in the Part 61 Manual of Standards, as in force from time to time.

 (2) The approved person must retain records of each person’s flight training for at least 7 years.
