Declaration (No. 66) – Airservices Australia

 

1  Name

  This instrument is the Competition and Consumer (Airservices Australia Prices Surveillance) Declaration 2018.

2  Commencement

  This instrument commences on the day after this instrument is registered.

3  Authority

  This instrument is made under subsections 95X(1) and (2) of the Competition and Consumer Act 2010.

4  Definitions

  In this instrument:

Act means the Competition and Consumer Act 2010.

Airservices Australia means the body called Airservices Australia established by subsection 7(1) of the Air Services Act 1995.

5  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

6  Notified Services

 (1) For the purposes of Part VIIA of the Act, services of the following kinds are notified services if a charge for the services has been set in a determination that is made under section 53 of the Air Services Act 1995 and in force at the time the services are supplied:

  (a)  terminal navigation;

  (b)  fire fighting and rescue;

  (c)  en route air route and airway facilities; and

  (d)  other safety related activities.

7   Declared Persons

 (1) For the purposes of Part VIIA of the Act, Airservices Australia is a declared person in relation to services that are notified services under section 6.

 (2) The declaration in subsection (1) ceases to have effect when this instrument is repealed.
