Part 1 - Preliminary

1  Name

1.            This instrument is the Migration (IMMI 18/009: Credentialled Community Language Qualifications) Instrument 2018.
2.            This instrument may also be cited as IMMI 18/009.

2  Commencement

This instrument commences on 26 March 2018.

3  Authority

The instrument is made under Item 6D91 of Part 6D.9 of Schedule 6 to the Regulations.

4  Definitions

In this instrument:

NAATI is National Accreditation Authority for Translators and Interpreters Ltd

Regulations means the Migration Regulations 1994

5  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Part 2 - Credentialled Community Language Qualifications

6  National Accreditation Authority for Translators and Interpreters

For the purposes of paragraph 6D91(a) of the Regulations, NAATI is specified as a credentialled community language body.

7  Standard for Interpreting or Translating

1.            The specified standard for interpreting or translating for the purposes of paragraph 6D91(b), is any one of the following issued by NAATI:

1.            accreditation at the paraprofessional level or above;
2.            certification at the certified provisional level or above; or
3.            a community language credential.

Part 3 —Transitional provisions

8  Application of this instrument

This instrument applies to any applicant who has not received a credentialled community language qualification issued by NAATI prior to the commencement of this instrument. Previous qualifications by NAATI at the specified standard will be recognised as a credentialled community language qualification.
