I, GRAEME MILLS CRAWFORD, Aviation Group Manager, a delegate of CASA, make this instrument under regulations 11.056 and 61.040 of the Civil Aviation Safety Regulations 1998 (CASR) for subregulations 61.150 (7) and 61.245 (3) of CASR.

Approval  approved pilots under Civil Aviation Order 29.10  flight tests and grant low-level rating, low-level endorsement and mustering endorsement – aeroplane

1 Duration

 This instrument:

(a) commences on 20 March 2017; and

(b) is repealed at the end of 30 June 2019.

2 Definitions

 In this instrument:

approved person means a person approved by section 4 of this instrument.

approved to act as an approved pilot means approved under subsection 12 of Civil Aviation Order 29.10, as in force at the time of approval, to act as an approved pilot.

Note   Civil Aviation Order 29.10 has been amended and no longer provides for approved pilots.

examiner proficiency check has the same meaning as in regulation 61.1285 of CASR, as in force from time to time.

Note   The requirements and standards for an examiner proficiency check are set out in Appendix 6 of Schedule 6 of the Part 61 Manual of Standards.

FTNS means the CASA Flight Test Notification System.

professional development means:

(a) a professional development program conducted by CASA mentioned in paragraph 61.1270 (a) of CASR, as in force from time to time; or

(b) an approved course of professional development conducted by the holder of an approval mentioned in paragraph 61.1270 (b) of CASR, as in force from time to time.

3 Application

 This instrument applies to a person who:

(a) on 31 August 2014, was approved to act as an approved pilot in an aeroplane; and

(b) has never been granted a low-level rating flight test endorsement (aeroplane) or an aerial application rating flight test endorsement (aeroplane).

4 Approval

 (1)I approve a person mentioned in section 3:

(a) to conduct a flight test for a low-level rating, an aeroplane low-level endorsement and an aerial mustering – aeroplane endorsement; and

(b) to grant a low-level rating, an aeroplane low-level endorsement and an aerial mustering – aeroplane endorsement.

 (2)An approval is subject to the conditions mentioned in section 5.

5 Conditions

 (1)An approved person must be registered with FTNS and must use FTNS as the method of flight test notification.

 (2) Before FTNS registration, the approved person must have provided evidence to the Flight Standards Branch of CASA that the approved person was approved to act as an approved pilot on 31 August 2014.

 (3) An approved person must comply with the limitations and obligations of the holder of a flight examiner rating under Subpart 61.U of CASR, as in force from time to time, other than subregulation 61.1265 (1) and regulations 61.1270 and 61.1285 of CASR.

 (4) An approved person must complete professional development and an examiner proficiency check by the date mentioned for the person in subsection (5).

Note   The date by which the approved person must complete these requirements depends on the month and year in which the person was born.

 (5) For subsection (4), for each month in column 1 of the table, the date for an approved person whose birthday occurs during the month is:

(a) if the person’s year of birth is an odd number (e.g. 1969, 1971) — the date mentioned in column 2 of the table;

(b) if the person’s year of birth is an even number (e.g. 1970, 1972) — the date mentioned in column 3 of the table.
