Broadcasting (Hours of Local Content) Declaration No. 1 of 2017

This Declaration is the Broadcasting (Hours of Local Content) Declaration No.1 of 2017.
2. Commencement
This Declaration commences on the day after it is registered on the Federal Register of Legislation.
3. Authority
This Declaration is made under paragraph 43C(3)(c) of the Broadcasting Services Act 1992.
4. Repeal
The Broadcasting (Hours of Local Content) Declaration No.1 of 2007 in force immediately before this Declaration commences is repealed.
5. Definitions
In this Declaration:
Act means the Broadcasting Services Act 1992.
ACMA means the Australian Communications and Media Authority.
regional commercial radio broadcasting licence has the meaning given by subsection 43C(8) of the Act.
small licence means a regional commercial radio broadcasting licence located in a licence area in which the total population of the licence area is fewer than 30,000 people, according to the most recent determination made by ACMA under section 30 of the Act.
6. Applicable Number
(1) For a licence that is a small licence, the applicable number is 30 minutes.
(2) For other regional commercial radio broadcasting licences, the applicable number is 3 hours.
Note: Subsection 43C(2A) of the Act provides that regional commercial radio broadcasting licence conditions relating to local content do not apply to a regional racing service radio licence, a remote area service radio licence, and a licence allocated under subsection 40(1).
