1  Name

  This instrument is the Primary Industries Legislation Amendment (Wine) Regulations 2017.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under the following:

 (a) the Primary Industries (Customs) Charges Act 1999;

 (b) the Primary Industries Levies and Charges Collection Act 1991.

4  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

Part 1Amendments relating to the Australian Grape and Wine Authority

Primary Industries (Customs) Charges Regulations 2000

1  Clause 1 of Schedule 13

Omit “Australian Wine and Brandy Corporation Act 1980”, substitute “Australian Grape and Wine Authority Act 2013”.

2  Clause 1 of Schedule 13 (note)

Omit “Australian Wine and Brandy Corporation Regulations”, substitute “Australian Grape and Wine Authority Regulations 1981”.

Primary Industries Levies and Charges Collection Regulations 1991

3  Clause 2 of Schedule 35

Insert:

Authority means the Australian Grape and Wine Authority.

4  Clause 2 of Schedule 35 (definition of Corporation)

Repeal the definition.

5  Clause 2 of Schedule 35 (definition of licence)

Omit “issued under regulation 5 of the Australian Wine and Brandy Corporation Regulations,”, substitute “granted under regulation 5 of the Australian Grape and Wine Authority Regulations 1981,”.

6  Clause 5 of Schedule 35 (heading)

Repeal the heading, substitute:

Omit “the Corporation”, substitute “the Authority”.

Part 2Amendments relating to returns

Primary Industries Levies and Charges Collection Regulations 1991

8  Clause 7 of Schedule 35

Omit “must lodge a quarterly return”, substitute “that has exported wine (other than exempt wine) in a quarter must lodge a quarterly return for the quarter”.

Omit “$200”, substitute “$1,000”.

Omit “$200”, substitute “$1,000”.
