I, Dan Tehan, Minister for Veterans’ Affairs, approve:

(a)     under subsection 117(3) of the Veterans’ Entitlements Act 1986, the variations by the Repatriation Commission of the Veterans’ Children Education Scheme in the following instrument; and

 

(b)    under subsection 258(5) of the Military Rehabilitation and Compensation Act 2004,  the variations by the Military Rehabilitation and Compensation Commission of the Military Rehabilitation and Compensation Act Education and Training Scheme 2004 in the following instrument.

1        Name

 This instrument is the Veterans’ Affairs Children Education Schemes (Indigenous Students Assistance Scholarships and Other Matters) Amendment Instrument 2016.

 

 

2        Commencement

 

(1)          Each provision of this Instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3        Authority

 This instrument is made under:

 

(a)   subsection 117(2) of the Veterans’ Entitlements Act 1986 in respect of the variations to the Veterans’ Children Education Scheme; and

 

(b)   subsection 258(4) of the Military Rehabilitation and Compensation Act in respect of the variations to the Military Rehabilitation and Compensation Act Education and Training Scheme 2004.

 Each instrument that is specified in a Schedule to this instrument is varied as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Insert:

disqualifying accommodation scholarship means:

 (a) a scholarship:

 (i) provided for under Part 2‑2A of the Higher Education Support Act 2003 (Indigenous student assistance grants); and

 (ii) specified under subsection 23(24) of the Social Security Act 1991 for the purposes of subparagraph (a)(ii) of the definition of disqualifying accommodation scholarship in subsection 23(1) of that Act; or

 (b) a Commonwealth Accommodation Scholarship.

 

disqualifying education costs scholarship means:

 (a) a scholarship:

 (i) provided for under Part 2‑2A of the Higher Education Support Act 2003 (Indigenous student assistance grants); and

 (ii) specified under subsection 23(24) of the Social Security Act 1991 for the purposes of subparagraph (a)(ii) of the definition of disqualifying education costs scholarship in subsection 23(1) of that Act; or

 (b) a Commonwealth Education Costs Scholarship.
