WORKING HOLIDAY VISA – DEFINITIONS OF SPECIFIED WORK AND REGIONAL AUSTRALIA 2016/041

(subitem 1225(5))

I, PETER DUTTON, Minister for Immigration and Border Protection, acting under subitem 1225(5) of Schedule 1 to the Migration Regulations 1994 (the Regulations):

  1. REVOKE Instrument IMMI 08/048, Working Holiday Visa – Definitions of ‘Specified Work’ and ‘Regional Australia’ (F2008L02264), signed on 23 June 2008; and
  2. SPECIFY for the purposes of subitem 1225(5)  of Schedule 1 to the Regulations:

(a)          a suburb or location postcode listed in the Schedule to this Instrument, that is identifying that suburb or location as a regional Australia place; and

(b)          specified work to be any type of work identified in the list below:

(i)               plant and animal cultivation:

  1. the harvesting and/or packing of fruit and vegetable crops;
  2. pruning and trimming vines and trees;
  3. general maintenance crop work;
  4. cultivating or propagating plants, fungi or their products or parts;
  5. immediate processing of plant products;
  6. maintaining animals for the purposes of selling them or their bodily produce, including natural increase;
  7. immediate processing of animal products including shearing, butchery, packing and tanning;
  8. manufacturing dairy produce from raw material.

(ii)            fishing and pearling:

  1. conducting operations relating directly to taking or catching fish and other aquatic species;
  2. conducting operations relating directly to taking or culturing pearls or pearl shell.

(iii)            tree farming and felling:

  1. planting or tending trees in a plantation or forest that are intended to be felled;
  2. felling trees in a plantation or forest;
  3. transporting trees or parts of trees that were felled in a plantation or forest to the place where they are first to be milled or processed or form which they are to be transported to the place where they are to be milled or processed.

(iv)            mining:

  1. coal mining;
  2. oil and gas extraction;
  3. metal ore mining;
  4. construction material mining;
  5. other non-metallic mineral mining and quarrying;
  6. exploration;
  7. mining support services.

(v)            construction:

  1. residential building construction;
  2. non-residential building construction;
  3. heavy and civil engineering construction;
  4. land development and site preparation services;
  5. building structure services;
  6. building installation services;
  7. building completion services;
  8. other construction services.

This Instrument, Working Holiday Visa – Definitions of Specified Work and Regional Australia, IMMI 16/041 commences on 1 July 2016.
