5 Statement of reasons for issue of certificate
For paragraph 51(2)(a) of the Act, this section sets out the statement of the reasons for the issue of this certificate.
Statement of reasons
I am satisfied that the Legal Services Directions 2005 (the Directions) made under section 55ZF of the Judiciary Act 1903 would, apart from the operation of Part 6 of the Act, be likely to cease to be in force within 12 months after the scheduled sunsetting day.
The Secretary of the Attorney‑General’s Department is undertaking a review of Commonwealth legal work. The review is examining how legal work can be delivered most effectively and efficiently to the Commonwealth, and will include consideration of changes to a number of aspects of the Directions. The Government anticipates that the Directions will be repealed and remade in early 2017.
The Directions are due to sunset on 1 April 2016. A 12 month deferral of the sunsetting day for these Directions will avoid the need to remake them in their current form for the short period before new Directions are made and commence.
6 Deferral of sunsetting of the Legal Services Directions 2005
The Legal Services Directions 2005, for which the sunsetting day is 1 April 2016, are taken to cease to be in force under section 51 of the Act on 1 April 2017.
This instrument is repealed on 2 April 2017.
