Exemption — from certain prerequisites for an ATPL flight test

1 Duration

  This instrument:

(a) commences on the day of registration; and

(b) expires at the end of 30 November 2017, as if it had been repealed by another instrument.

2 Definitions

 (1) In this instrument:

  ATPL means air transport pilot licence.

  CASR 1998 means the Civil Aviation Safety Regulations 1998.

 (2) In this instrument, unless the contrary intention appears:

(a) words and phrases have the same meaning as in CASR 1998; and

(b) a reference to a provision commencing with the numerals “61” is a reference to the provision of the same number in Part 61 of CASR 1998.

3 Application

 (1) This instrument (other than subsection (2) and section 5) applies to an applicant for an ATPL who has passed the aeronautical knowledge examination for the ATPL with a score of less than 100% (ATPL applicant).

 (2) This instrument (other than subsection (1) and section 4) applies to an applicant for an ATPL who is the holder of an overseas ATPL (overseas ATPL holder).

4 Exemption — ATPL applicant’s knowledge deficiency report

  An ATPL applicant is exempt from:

(a) the requirements of paragraph 61.235 (2) (b); and

Note   Paragraph 61.235 (2) (b) refers to knowledge deficiency reports.

(b) regulation 61.240 — but only to the extent that, at the time the applicant takes the ATPL flight test, the eligibility requirements under paragraph 61.235 (2) (b) have not been met.

Note   The flight test requires an oral assessment of knowledge: see clause 2 in Appendix K.1 in Section K of Schedule 5 of the Part 61 Manual of Standards.

5 Exemption — overseas ATPL holder’s competency certification

  An overseas ATPL holder is exempt from subparagraph 61.275 (1) (e) (i).

Note   Subparagraph 61.275 (1) (e) (i) refers to competency units under the Part 61 Manual of Standards.
