I, Michael Keenan, Minister for Justice, make this Determination under subsection 1061KA(5) of the Social Security Act 1991.

1 Name of Determination

  This Determination is the Social Security (Disaster Recovery Allowance) (Prescribed payments) Determination 2013.

2 Commencement

  This Determination commences on the day after it is registered.

3 Definitions

  In this Determination:

  ABSTUDY Living Allowance means Living Allowance payable under the ABSTUDY Scheme.

  ABSTUDY Scheme means the Aboriginal and Torres Strait Islander Study Assistance Scheme.

  Act means the Social Security Act 1991.

  bereavement allowance means payment, so styled, payable under Part 2.7 the Act.

  dad and partner pay means dad and partner pay under the Paid Parental Leave Act 2010.

  exceptional circumstances relief payment means payment, so styled, made under the Farm Household Support Act 1992.

  income support supplement means payment, so styled, payable under Part IIIA of the Veteran’s Entitlements Act 1986.

  interim income support means payment, so styled, made under the interim income support policy guidelines, administered by the Commonwealth.  

  parental leave pay means parental leave pay under the Paid Parental Leave Act 2010.

  partner allowance means payment, so styled, payable under Part 2.15A of the Act.

  service pension has the meaning given by subsection 5Q(1) of the Veteran’s Entitlements Act 1986.             

  sickness allowance means payment, so styled, payable under Part 2.14 of the Act.

  special benefit means payment, so styled, payable under Part 2.15 of the Act.

  transitional farm family payment means payment, so styled, made under the program administered by the Commonwealth known as the Transitional Farm Family Payment program.

4 Excluding Payments

  For the purposes of paragraph 1061KA(1)(h) of the Act, the following payments are prescribed payments:

(a)        an exceptional circumstances relief payment;

(b)       a transitional farm family payment;

(c)        an instalment of

(i)     interim income support;

(ii)  parental leave pay;

(iii) dad and partner pay;

(d)       a payment by way of

(i)     service pension;

(ii)  income support supplement;

(iii) bereavement allowance;

(iv) special benefit;

(v)   ABSTUDY Living Allowance;

(vi) partner allowance;

(vii)   sickness allowance.
